fa ملاک‌ها و ضوابط ارزیابی خسارات ناشی از نقض حقوق مالکیت فکری در حقوق داخلی و برخی معاهدات و قوانین خارجی مروری Review Article <p>در بحث ملاک‌ها و ضوابط ارزیابی خسارات ناشی از نقض حقوق مالکیت فکری، هرچند نوع خسارت از این جهت که قابل مطالبه باشد یا خیر به عنوان ضابطه تقویم، نقش دارد، نوع خسارت به خودی خود می‌تواند ملاک و ضابطه ارزیابی هم به شمار آید. با وجود این، در نظام حقوقی کشورمان، برای ارزیابی خسارات ناشی از نقض حقوق مزبور، ملاک خاصی پیش‌بینی نشده است. در حالی که در نظام‌ حقوقی کشورهای توسعه‌یافته اختصاصاً چنین ملاک‌‌هایی پیش‌بینی شده، اگرچه در چند و چون آن‌، اختلاف نظر و تشتت آرا هست. بر این پایه، در نظام‌های حقوقی مورد مطالعه، اولاً ملاک و ضابطه یکسان برای تقویم تمام انواع نقض، وجود ندارد؛ ثانیاً بسیاری از آنچه که به عنوان ضابطه ارزیابی تلقی می‌شود در تعیین نوع خسارت هم دخیل می‌باشد؛ ثالثاً ملاک‌های مطرح در این حوزه، آنچنان جامع و مطلق نیست که هرگونه نقض حق ناشی از اموال فکری با هر نوع موضوع و ماهیت را پوشش دهد. ضمن این‌که تقویم این‌گونه خسارات، یک کار حقوقی قضایی صرف هم نمی‌باشد. بلکه این موضوع علاوه بر جنبه&lrm;ی حقوقی و قضایی، واجد جنبه‌های اقتصادی، مالی و حسابداری نیز هست.</p> <div align="justify" style="direction: ltr">In discussion of criteria for evaluation of damages due to copyright infringement, although the type of damage plays a role as a test to be demandable or not, the type of damage may be also automatically considered as a valuation criterion for evaluation. However, in our country&#39;s legal system, no special criterion for evaluation of damages arisen from infringement has been anticipated. This is while in the legal system of developed countries such special criteria have been anticipated. However, there is controversy on quality and quantity of determined criteria. On this base, in studied legal systems, firstly, there is not the same test and criteria for evaluation of all kinds of violated rights and secondly, most of the things considered as a test for evaluation, are also involved to determine the type of damage. Thirdly, those tests known in this area, are not well comprehensive and unconditional be able to cover all kinds of infringement with any subject and nature.
