fa بررسی وضعیت حقوقی سازمان‌های مدیریت جمعی در جهان کنونی مروری Review Article <p dir="RTL">سازمان‌های مدیریت جمعی، گونه منسجم و جمعی اداره حقوق مالکیت ادبی و هنری هستند که در موقعیت‌های ناشی از پیچیدگی و گستردگی دسترسی به آثار، به احقاق حق مؤلفان و هنرمندان می‌پردازند. این سازمان‌ها در کشورهای مختلف با عنایت به شرایط سیاسی، اجتماعی و فرهنگی ملی از تنوع زیادی برخوردارند. در مقاله حاضر تلاش می‌شود با تکیه بر روش تحلیلی ـ توصیفی ضمن مطالعه تطبیقی سازمان‌ها در کشورهای گوناگون، تفاوت‌ها و شباهت‌های نظام‌های حقوق نوشته و عرفی را در تأسیس سازمان، نقش دولت در سازمان‌ها، روابط اعضا و کاربران با سازمان واکاوی نموده و سرانجام به بیان پیشنهادات مقتضی بپردازد. با وجود این، می‌توان پذیرفت که اکنون مرزهای سنتی نظام حقوق نوشته و عرفی دچار تغییر شده و از یکدیگر متأثر گردیده‌اند. از این رو سازمان‌های معاصر آمیزه‌ای از هر دو نظام خواهند بود.</p> <p>Collective management organization is a consistent and collective kind of management of literary and artistic property rights that benefits authors and artists in situations of complexity and extent of access to the works. These organizations are facing with the diversity in different countries with regard to the political, social and cultural national. Recent paper attempts to study descriptive -analytical the organizations in different countries, differences and similarities of civil law and common Law systems and the establishment of the organization, the role of government in the organization, relationships with the organization&#39;s members and users, and finally to express their appropriate suggestions. Nevertheless, it is plausible that the traditional boundaries of civil law and common Law system metamorphosed and from each other, have been affected.
