fa نقش وزارت فرهنگ و ارشاد اسلامی در فرایند شکل‌گیری و حیات مؤسسات مدیریت جمعی حقوق در ایران با الهام از حقوق فرانسه پژوهشي Original Article <p><span dir="RTL">تأسیس سازمان‌های مدیریت جمعی در نظام حقوقی ایران برای اولین‌بار در لایحه قانون جامع حقوق مالکیت ادبی ـ هنری و حقوق مرتبط که توسط وزارت فرهنگ و ارشاد اسلامی تدوین و به دولت پیشنهاد شده، پیش‌بینی شده است. با توجه به فقدان سابقه تقنینی در خصوص موضوع و همچنین عدم فعالیت عملی این مؤسسات یا مؤسساتی با کارکرد مشابه در کشور و به ویژه به دلیل اهمیتی که این مؤسسات در تجاری‌کردن آثار و اشیای موضوع حقوق مرتبط دارند، لازم است چارچوب این مؤسسات و نحوه عملکردشان از حیث قانونی تعیین شود. از آنجا که این مؤسسات مدیر اجرایی پدیدآورندگان آثار هستند که وزارت فرهنگ در کشور ما متولی اصلی حمایت از آن‌هاست، ضروری است نقش این دستگاه حاکمیتی در تأسیس و شکل‌گیری، انحلال و به ویژه نظارت بر عملکرد آن‌ها ترسیم گردد. این امر تنها از طریق بررسی تطبیقی تجارب کشورهای دارای سابقه در این موضوع و بهره‌گیری از مقررات قانونی آن‌ها میسر است. به دلیل نزدیکی سیستم قانونی ما با سیستم فرانسوی، در این تحقیق به چگونگی تأسیس و نحوه عملکرد این مؤسسات در فرانسه می‌پردازیم و با تأسی از آن برخی وظایف و اختیارات وزارت فرهنگ را در این‌باره برمی‌شماریم.</span></p> <p>The establishment of collective management organizations (CMO) has been envisaged in draft of comprehensive act for protection of literary and artistic ownership and related rights by the Ministry of Culture and Islamic Guidance of Iran. At the moment, no such organizations or similar institutions exist in Iran. Due to the lack of legislative background as well as lack of practice of such organizations, and particularly due to the importance of CMOs in commercialization of the works that are subject to copyright and related rights, it is necessary that their structures and functions are determined by law. Since CMOs manage the rights of the creators and the Ministry is the authority to provide the protection for the right holders, it is essential that the role of the Ministry of culture and Islamic guidance is clarified in connection with the establishment, structures and functions of CMOs. In this context, the experience of the states such as France because of their similarities with the Iranian legal system is of particular importance.
