fa سهم منصفانه پدیدآورندگان در قراردادهای تجاری‌سازی آثار ادبی و هنری و نقش سازمان‌های مدیریت جمعی در تحقق آن پژوهشي Original Article <p dir="RTL">در فرایند انعقاد قراردادهای تجاری‌سازی آثار ادبی و هنری، گاه بنگاه تجاری‌ساز (نظیر ناشرین کتاب و...)، سهم منصفانه‌ای را برای پدیدآورنده در نظر نمی‌گیرند و خالقان اثر نیز به عنوان طرف ضعیف‌تر این قراردادها، ناگزیرند قراردادِ از پیش تنظیمی را امضا کرده و به سهم غیر منصفانه‌شان اعتراضی نکنند. در قوانین داخلی برخی کشورها، بر لزوم تعلق سهم منصفانه به صاحب اثر تأکید و تصریح شده است، اما برای اجرایی‌کردن این مقررات، علاوه بر لزوم وجود قانون، سازمان‌های مدیریت جمعی نیز می‌توانند اثر به سزایی داشته باشند. با عنایت به این‌که این موضوع مهم و کاربردی تاکنون در ادبیات حقوقی ما مورد توجه نبوده است، لذا مقاله حاضر برای رفع نسبی این خلأ تحقیقاتی، در دو بخش ارائه می‌شود: در بخش نخست، مفهوم و معیارهای تعیین سهم منصفانه تبیین شده و نقش سازمان‌های مدیریت جمعی در تحقق آن در قراردادهای تجاری‌سازی همراه با مطالعه تطبیقی بررسی می‌گردد و در بخش دوم، جایگاه موضوع در حقوق ایران نقد شده و ضمن بررسی مقررات موجود، نگاهی نیز به لایحه حمایت از مالکیت فکری انداخته می‌شود. در پایان هم راهکارهای کاربردی به گروه‌های بهره‌بردار از نتایج تحقیق عرضه می‌گردد.</p> <p>Sometimes, commercialization firms (such as publicators) do not respect the equitable share of the creators of literary and artistic works in commercialization contracts. Since the creators are considered as the weaker party of contract, adopt unfair share and do not protest unfair clause of contract regulated by another party. The national laws and regulations of several countries have emphasized on the equitable share of the owner of literary and artistic works. For implementation of the mentioned right, we need collective management organizations (CMOs) in addition to laws and regulations. Whereas Iranian legal literature has not paid attention to this important and practical issue, this article tries to fulfill the current lack of research approximately. This survey constitutes two parts. The first part allocates to the concept and criteria of equitable share and the role of CMOs with comparative approach. The second part considers the exsiting reulations and bill of intellectual property protection of Iran.
