fa نگاهی به نظریه های مبانی والدینی <p style="text-align: justify;">پیشرفتهای شگرف در فناوریهای تولیدمثل در سالیان اخیر اگر چه حل مسأله ناباروری را ممکن ساخته اما در مقابل مسائلی را در حوزه فقه، حقوق، فلسفه، اخلاق، و جامعه شناسی مطرح کرده است که حل آنها به مراتب از درمان ناباروری دشوارتر به نظر میرسد. یکی از مهمترین این مسائل، رابطه پدرمادری است. یا به عبارت دقیقتر پاسخ به این مسأله که چه کسی پدر و مادر طفل متولد شده از طریق تکنولوژیهای درمان ناباروری است. بررسی تئوریهای داده شده در این زمینه و انتخاب یکی از چهار رویکرد ژنتیک گرایی، بارداری گرایی، قصدگرایی و سبب گرایی در نظام حقوقی ایران با توجه به حجم مراجعین به این درمان در میان زوجین ایرانی و روبه روشدن با هزاران کودک این چنینی در چند دهه آینده از اهمیت بسیاری برخواردار است. نگارنده در این مقاله پس از بررسی دیدگاه اسلام و حقوق ایران به مسأله نسب، به بررسی ادبیات موجود در زمینه رابطه پدر مادری برآمده و پس از بررسی دیدگاههای موافقین و مخالفین هر رویکرد، به انتخاب سببگرایی قصدمدار به عنوان بهترین روش برمیآید.</p> <p>Although considerable developments in reproductive technologies made it possible to solve the problem of sterility, it posed some questions in the areas of Islamic jurisprudence, law, philosophy, ethics and sociology. Solving these problems seems to be even more difficult than those caused by sterility. One of these questions is the relationship of the child and his/her parents. In other words, it is the response to a question: Who is the parent of the child who is bored as a result of technologies related to sterility therapy? Studying the theories presented in this field and choosing one out of four following choices in Iranian legal system are very important. Genetic-based, pregnancy-based, intent-based and cause-based theories. A number of Iranian couples refer to special clinics and there will be number babies who will be borne through such technologies. Studying the viewpoints of Islam and Iranian legal system about geneology, the author of the present article, reviewed the literature of parental relationship.
