fa حقوق متّهمان و محکومان بیمار در نظام عدالت کیفری ایران <p dir="RTL">متهمان و محکومان بیمار به سبب برخورداری از شرایط روحی و جسمی خاص، مستحق حمایت ویژه دستگاه قضا در سیر دادرسی کیفری هستند؛ به عبارتی در نظام عدالت کیفری باید برای این گروه از افراد در جهت رعایت موازین دادرسی عادلانه و جلوگیری از به خطر افتادن سلامتی آنان، سیاست افتراقی ـ حمایتی پیش بینی و مقامات قضایی را مکلف به رعایت آن نمود.</p> <p dir="RTL">قانون‌گذار ایران در مجموعه قوانین کیفری به‌ویژه در مرحله‌ی اجرای احکام تاحدودی به این امر توجه نموده است. به‌گونه‌ای که در اکثر موارد ابتلای محکوم به بیماری روحی و جسمی را نه موجب ساقط شدن مجازات بلکه موجب تأخیر اجرای حکم تا زمان بهبودی دانسته است. البته هنوز جای خالی قواعدی از قبیل ضرورت حضور وکیل بدون قید و شرط در کلیه مراحل دادرسی در کنار متّهمان بیمار، توجه به وضعیت جسمانی متّهمان در مرحله تحقیقات مقدماتی و دادرسی، ممنوعیت اعمال هرگونه مجازات نسبت به محکومان مجنون و... احساس می‌شود.</p> <p>Patient accused and convicts, for the special mental and physical conditions they have, are entitled to particular protection from the criminal system in their criminal procedures. Therefore, certain protective-distinguishing policies must be anticipated for this group of people in order to observe equitable procedure standards as well as avoid jeopardizing their general health. In the collection of criminal law especially in law enforcement stage, Iranian legislator has to some extent paid attention to this issue, i.e., in the majority of cases where the accused suffers from a particular physical and / or mental state, this leads not to the annulment of punishment but to a delay thereof until due recovery is obtained.
