fa تعارض و توازن منافع در حفظ حریم خصوصی و افشای اطلاعات ژنتیکی بیماران <p dir="RTL">ظهور روش‌های نوین علم ژنتیک در عرصه پیشگیری، تشخیص و درمان بیماری‌ها، چالش‌های بسیاری در چگونگی تنظیم روابط و قانونگذاری مناسب به منظور حفظ حقوق بیماران به همراه خواهد داشت. بکارگیری گسترده اطلاعات ژنتیکی با هدف ارتقای سلامت فردی و اجتماعی، با عنایت به ویژگی‌های خاص این‌گونه اطلاعات که متضمن برداشت‌های متفاوت و حصول نتایج حساس و تأثیرگزار در آینده بیمار، بستگان وی و جامعه می‌باشند؛ و به موازات آن حفظ حریم خصوصی بیمار به عنوان حقی بنیادین و برگرفته از لزوم احترام به شأن و کرامت انسانی، از مصادیق بارز چالش‌های مذکور به حساب می‌آید. امکان بکارگیری اطلاعات ژنتیکی بدست‌ آمده از بیماران در حوزه‌های غیردرمانی و سلامتی ایشان نظیر استخدام نیروی کار، تنظیم قراردادهای بیمه (عمر یا سلامت)، پژوهش‌های عمومی پزشکی یا استفاده از آنها در روند رسیدگی‌های قضایی محاکم و...، زمینه سوءاستفاده از اطلاعات ژنتیکی و بیم تغییر فضای درمانی پیرامون آنها به فضای تجاری را فراهم نموده و در نتیجه چگونگی حفظ حقوق بیمار در جوامع امروزی را به امری خطیر مبدل نموده است. مقاله حاضر با بیان ضرورت حفظ حریم خصوصی بیمار همگام با افشای منطقی و عقلانی اطلاعات ژنتیکی، چگونگی برقراری توازن میان نفع شخصی افراد در تقابل با نفع جامعه و همچنین ایجاد تعادل در منافع متعارض اشخاص ذینفع را مورد بررسی قرار داده و در راستای نیل به آرمان حفظ حریم ژنتیکی بیمار، به لزوم قانونگذاری مناسب و ارائه معیارهای دقیق، همزمان با آموزش عمومی به اقشار جامعه اذعان می‌نماید.</p> <p>The emergence of new genetic techniques in the area of preventation, diagnosis and treatment of diseases is expected to bring many challenges in regulating relationships and appropriate legislation to protect the patients&rsquo; right. The widespread use of genetic information in improving individual and public health, regarding to its special traits with potential for different interpretations and sensitive and effective outcomes in the future of a patient, his family and the society, simultaneous with keeping patient&rsquo;s privacy, as a fundamental right which originates from the concept of human dignity, is one of those challenges. The possible utilization of patient&rsquo;s genetic information in the areas other than therapy and health e.g. employment, provision of insurance contracts (life or health styles), public medical researches as well as in the process of judicial trials, makes it possible to misuse genetic information and raises the fear of change in treatment space into commercial one and ultimately makes genetic privacy as a serious issue in the present societies.
