fa بررسی نقش اراده در تحقق مسؤولیت کیفری در نظریات جرم‌شناختی و تأثیر آن بر مسؤولیت کیفری منحرفین جنسی <p dir="RTL">چگونگی مواجهه با مجرمان و اشخاصی که به هر نحوی از انحاء به عملی خلاف قوانین، قواعد، هنجارها و ارزش‌های مقبول هر جامعه مبادرت می‌ورزند از جمله مسایل دیرپای فلسفی و حقوقی است. برخوردهای کیفری و اعمال مجازات بر خاطیان از اصول و قواعد هر جامعه و قائل‌شدن به مسؤولیت کیفری افراد، عمری به درازای بشریت دارد که متأثّر از نوع نگاه به مقوله‌ی جرم و مجازات در هر دوره‌ی تاریخی دچار تحوّل گردیده است. در این میان نظریات جرم‌شناسی در طول تاریخ پیدایش خود تأثیر به‌سزایی بر تحوّلات مربوط به مسؤولیت کیفری داشته‌اند. توجّه به عنصر اراده به عنوان زیربنای مسؤولیت کیفری در تمامی نظریات جرم شناختی قابل مشاهده بوده و در طول تاریخ جرم‌شناسی با نوسانات بسیاری از اطلاق‌ انگاری اراده تا نفی اراده رو به رو شده است. اهمّیت این تحوّلات در اراده‌ی نسبی برخی از مرتکبین انحرافات و جرایمی مانند انحرافات جنسی است. زیرا دستاوردهای جدید علمی ثابت کرده‌اند که بسیاری از منحرفین جنسی به هنگام انجام رفتار انحرافی از اراده‌ی تام برخوردار نبوده و دارای اراده&nbsp; نسبی هستند. بدون شک دستاوردهای نظریات جرم‌شناختی مانند تئوری مسؤولیت نقصان یافته تأثیر به‌سزایی در تحوّلات مسؤولیت کیفری داشته که مسؤولیت کیفری منحرفین جنسی نیز بی‌بهره از این دستاوردها نخواهد بود.</p> <p align="left"><strong>Abstract</strong></p> <p>A longstanding philosophical and legal issue is how to deal with criminals and persons who in some ways act against the acceptable laws, rules, norms and values in any society. Criminal copings and imposing punishments on those who violate the principles and rules of any society and maintaining criminal responsibility for the individuals are as old as humanity. Meanwhile, the theories of criminology have had great effect on the developments concerning the criminal responsibility throughout their histories of emergence. Noting the element of will as the foundation of criminal responsibility can be observed in all criminological theories and throughout the history of criminology has faced many fluctuations from the absolutism of will to its negation. The importance of these developments lies within the relative wills of some perpetrators of deviations and crimes such as sexual perversions.&nbsp;Because new scientific achievements have proven that many sexual perverts do not enjoy complete will when doing the deviant behavior and have relative wills.
