fa تابعیت اطفال متولد از تلقیح مصنوعی <p dir="RTL">در مورد وضعیت حقوقی اطفال متولد از تلقیح مصنوعی مباحث فراوانی قابل طرح و بررسی است. این در حالی است که تنها قانونی که در این مورد وضع گردیده، قانون &laquo;نحوه اهدای جنین به زوجین نابارور&raquo; است که در پنج ماده تنظیم گردیده و بسیاری پرسش‌ها در این زمینه را بی‌پاسخ گذارده است. یکی از مباحث حقوقی مطرح در مورد چنین اطفالی، بحث تابعیت آن‌هاست. در این مورد حکم خاصی از سوی قانونگذار وضع نگردیده و تابعیت این اطفال را به موجب قواعد عمومی تابعیت، باید تعیین نمود. با اعمال قواعد عمومی تابعیت، در مواردی ممکن است تابعیت طفل با زوجین اهداگیرنده متفاوت باشد. این تفاوت، جامعه، طفل و زوجین اهداگیرنده را با مشکلاتی روبه‌رو خواهد کرد. در نهایت پیشنهاد می‌گردد با توجه به آزادی دولت‌ها در تعیین اتباع خود، قانونگذار ایران به چنین اطفالی تابعیت ایران را اعطا نماید.</p> <p>There are so much discussable issues about legal statues of the kids born of artificial insemination. This is while the only law that had been set about this issue is &quot;the ways of presenting Fetus to the infertile couple law&quot; that had been conducted in 5 articles and had left so many unanswered questions in this subject. One of the legal considered subjects about these kids is their nationality. There isn&#39;t any special passed law by the lawmaker and these kids&rsquo; nationality should be determined based on the public regulations. By exerting the public rules of nationality in some cases there might be some differences in kid&rsquo;s nationality with the recipient couples. This difference makes troubles for the community, kid and the recipient couple.
