fa وضعیت حقوقی جنین فریزشده پژوهشي Original Article <p dir="RTL"><strong>زمینه و هدف:</strong> یکی از دستاوردهای علم پزشکی در زمینه ناباروری زوجین انجماد جنین است. بدین‌گونه که اسپرم و تخمک زوجین را منجمد کرده تا در صورت لزوم بتوانند از آن استفاده کنند. در رابطه با احکام و حقوق جنین منجمد ابتدا باید وضعیت جنین منجمد را نسبت به مالیت‌داشتن یا شخصیت‌داشتن مشخص نمود.</p> <p dir="RTL"><strong>روش: </strong>روش مقاله حاضر، توصیفی ـ تحلیلی است و شیوه گردآوری اطلاعات، کتابخانه‌ای می‌باشد.</p> <p dir="RTL"><strong>یافته‌ها:</strong> در رابطه با ماهیت جنین منجمد سه نظر وجود دارد. گروهی جنین منجمد را مال تلقی کرده و برای آن ارزشی همانند یک شئ قائل شده‌اند. گروه دیگر معتقدند که جنین منجمد مانند یک انسان کامل دارای تمام حقوق و تکالیف است. گروه سوم بر این عقیده‌اند که جنین منجمد موجودی دارای احترام خاص است که باید مورد حمایت قرار بگیرد.</p> <p dir="RTL"><strong>بحث و نتیجه‌گیری:</strong> از بین نظرات ارائه‌شده نظر سوم که نظر بینابینی است، طرفداران بیشتری دارد. با توجه به حیات بالقوه جنین منجمد در صورت فوت یکی از زوجین، جنین منجمد نمی‌تواند به عنوان یکی از وراث قرار گیرد. همچنین وضعیت جنین منجمد در صورت جدایی زوجین منوط به محتوای قرارداد منعقدشده با کلینیک است که زوجین چه تصمیمی در مورد جنین‌های منجمد خود اتخاذ کرده‌اند.</p> <p><strong>Background and aim:</strong> One of the achievements of medical science in the field of infertility among couples is frozen embryo so that sperm and egg of couples is frozen to be able to use if necessary. According to the laws and the rights of frozen embryos, the question that needs to be addressed is whether frozen embryos consider as a property or as a person.</p> <p><strong>Method:</strong> This is a retrospective study based on extensive literature survey, translated articles, theses and benefiting from the experiences of other countries.</p> <p><strong>Findings:</strong> There are three theories about frozen embryos. A group considers it as a merely property&nbsp;which have a value as an object. Another group believes that frozen embryos have an independent personality including all the rights and duties of the perfect man. The third group believes that the frozen embryo has a certain respect that should be supported.</p> <p><strong>Conclusion:</strong> among the presented opinions, the one which is an interstitial comment has more fans. According to the potential life of frozen embryos in case of death of one spouse, frozen embryos cannot be used as one of the heirs. Moreover, frozen embryos of separated couple are related to the content of the contract with clinic that what their decision are about frozen embryos.</p> <p>Please cite this article as: Abbasi M, Parsa E, Parsa E.
