fa مفهوم روش‌های تشخیص در حقوق اختراعات در پرتو حق بر سلامت پژوهشي Original Article <p dir="RTL">اگرچه روش‌های تشخیص بیماری‌ها در ماده 4 قانون ثبت اختراعات، طرح‌های صنعتی و علائم تجاری کشور ما از حوزه اختراعات قابل حمایت خارج ‌شده‌اند، اما در خصوص ماهیت این استثنا و حدود و ثغور آن در نظام حقوقی ما مباحث چندانی مطرح نگردیده است. بررسی ماهیت روش‌های استثنا شده، مستلزم شناخت مبانی این استثنا می‌باشد و بدون در نظرگرفتن این مبانی نمی‌توان به شناخت صحیحی از ماهیت، حدود و ثغور روش‌های تشخیص پرداخت. برای استثنای روش‌های تشخیص از حوزه حمایت حقوق اختراعات مبانی متعددی ذکر گردیده است که می‌توان به حق دسترسی به سلامت به عنوان یکی از مهم‌ترین این مبانی اشاره کرد. در این مقاله ابتدا به بررسی چالش‌های حقوق بشری حمایت از روش‌های تشخیص خواهیم پرداخت، سپس به تفسیر ماهیت روش‌های تشخیص در پرتو حق دسترسی به سلامت می‌پردازیم و در پرتو این مبنا به بررسی تفاسیری که در اداره ثبت اختراعات اروپا در خصوص این روش‌ها مطرح گردیده است، می‌پردازیم. در پایان، با بهره‌گیری از این مبنا، مواردی همچون نقش مداخله پزشک و اعمال بر بدن انسان در صدق عنوان روش‌های تشخیص و شمول استثنا بر اجزای روش‌های تشخیص را بررسی خواهیم نمود.</p> <p>Although diagnostics methods in Article 4 of the patents, industrial designs and trademark act are excluded from patent protection, but about the nature and limits of the exception in our legal system has not raised much debate. The nature of the exception requires an understanding of the reasons of exception and regardless of these reasons we cannot reach a proper understanding of the nature and limits of diagnostic methods. Many reasons for excluding diagnostic methods from the scope of patentable invention are mentioned and the right to health are one of the most important of these reasons. In this paper, we firstly examine the human rights challenges of diagnostic methods patentability, and then interpret the nature of diagnostic methods in the light of the right to health. On this base we will examine the European Patent Office interpretations for these methods. By taking advantage of this base, we examine subjects, such as the role of medical intervention and practicing the methods on the human body in the coverage of this exclusion from patent protection.</p> <p>Please cite this article as: Jafarzadeh M, Omrani E, Ghari Seyed Fatemi SM.
