fa نقش شرکت‌های دارویی در جهانی‌سازی نظام حقوق مالکیت فکری پژوهشي Original Article <p dir="RTL"><strong>زمینه و هدف</strong>: جهان‌شمولی تجارت در دارایی‌های فکری، به این معنا است که در حال حاضر، منابع اطلاعاتی ناملموس، فارغ از مرزبندی‌های سیاسی، در هر جا و همه جا، تولید، مبادله و مصرف می‌شوند.</p> <p dir="RTL"><strong>روش:</strong> در این پژوهش، مقصود ما از جهانی‌سازی، فرایند یا مجموعه فرایندهایی است که یک اقتصاد جهانی هماهنگ، محیط زندگی واحد و یک شبکه پیچیده و فعال ارتباطات که سراسر گیتی را دربرمی‌گیرد، شامل می‌شود. بدین‌سان، نظام حقوق خصوصی و مالکیت فکری کشورهای جهان، مجموعه‌ای به هم وابسته را تشکیل داده و مرزهای جغرافیایی، سیاسی و اجتماعی، اگرچه به طور کامل نابود نمی‌شوند، اما کم‌رنگ خواهند شد.</p> <p dir="RTL"><strong>یافته‌ها</strong>: این مقاله، تلاشی است در راستای بررسی حقوقی سیاستگذاری‌های مختلف در حمایت از اختراعات دارویی و روند جهانی‌شدن آن. بنابراین در این تحقیق، بیش از توجه به تقسیمات جغرافیایی، عوامل تأثیرگذار و نیز سیر بین‌المللی و فراملی در حمایت از اختراعات دارویی (نظیر فعالیت‌های سازمان جهانی تجارت و اتحادیه اروپا) ملاحظه شده است.</p> <p dir="RTL"><strong>بحث و نتیجه‌گیری</strong>: می‌توان گفت مشابه با طرح نظریه حقوق بازرگانی فراملی، حمایت از اختراعات دارویی نیز گستره‌ای فراملی پیدا کرده و تبدیل به عرفی جهانی شده است. بدیهی است که تأکید بر سیر حقوقی نظام موجود در سطح ملی و جهانی، نباید باعث نادیده‌انگاشتن چالش‌های جهانی‌شدن ثبت و حمایت از اختراعات دارویی شود.</p> <p><strong>Background and aim:</strong> Intellectual property plays an increasingly vital role in global trade and economic development. Globalization of intellectual property rights means that intangible informational resources are now produced, exchanged and consumed anywhere and everywhere defying jurisdictional borders. Intellectual property has moved into the mainstream of national economic and developmental planning. In the recent years, it has also emerged as a central element of multilateral trade relations.</p> <p><strong>Methods:</strong> It is probably more accurate to portray intellectual property rights as a class of intangible business asset that is usually held by global companies such as pharmaceutical companies performing the (admittedly important) roles in the modern economy of investors, employers, distributors and marketers.</p> <p><strong>Findings:</strong> By globalization of intellectual property law, Individual pharmacologists are less frequently the ones who own and control the rights.</p> <p><strong>Conclusion:</strong> Viewed in isolation, globalization of intellectual property law is a stunning triumph of the pharmaceutical companies in making global IP rules and in enlisting states and international organizations to enforce them.
