fa مبتلایان به ایدز، شهروندانی مجازی با حقوقی نمادین <p>افراد مبتلا به ایدز در گستره مطالعات مربوط به حوزه حقوق شهروندی طیفی را تشکیل می‌دهند که به دلیل انگ‌های ناروای اجتماعی که تحت عنوان افراد آلوده یا غیراخلاقی بر آنان الصاق شده است از منزلتی که شایسته هر شهروند درجه یک می‌باشد محروم مانده‌اند. بررسی خاستگاه افول حقوق شهروندی از منظر باورهای سنتی و ذهنیت‌های منفی نسبت به افراد مبتلا به ایدز که در اذهان سایر شهروندان رسوخ کرده و تلفیق آن با عواملی که منجر به حاشیه‌نشینی و نقش انفعالی آنان در جامعه گردیده می‌تواند بسترساز اتخاذ نگرشی جامع به مسأله ضرورت تدارک تمهیدات قانونی در جهت حمایت از این طیف باشد. این مقاله تلاش می‌کند تا ضمن تبیین جلوه‌های حقوق شهروندی بر مبنای آموزه‌های حقوق بشری از جمله حق بر منع تبعیض، حق بر برخورداری از شغل، حق دسترسی به خدمات بهداشتی و درمانی و حق آزادی عبور و مرور و حق برخورداری از حریم خصوصی با تأمل بر رهیافت‌های نوین در حوزه حقوق شهروندی سازوکارهای پیش‌گیرانه و حمایتی برای افراد مبتلا به ایدز را مورد بازاندیشی قرار دهد. در این نوشتار تلاش می‌شود تا چالش‌هایی که افراد مبتلا به ایدز در دسترسی و بهره‌مندی از حقوق شهروندی هم پایه با سایر شهروندان با آن مواجه هستند و ناگزیر بازتاب آن را می‌توان در به محاق‌رفتن جایگاه آنان در جامعه شاهد بود، در پرتو رهنمودهای بین المللی و ظرفیت‌های موجود در قوانین ملی مورد بررسی قرار گیرد. بی‌تردید عدم حساس‌سازی آموزه‌های حقوق شهروندی در قبال وضعیت افراد مبتلا به ایدز سرنوشتی محتوم را برای آنان که همانا روبرو‌شدن با رفتارهای تبعیض‌آمیز در تمتع از مصادیق حقوق شهروندی است رقم خواهد زد.</p> <p>In the area of citizenship rights studies people living with HIV/AIDS constitute a range of citizens who are deprived of the status of which every citizens deserves because of undue social stigma as infected or immoral people. In the view of traditional believe and negative perceptions about people living with HIV/AIDS penetrated to other citizens minds and putting together with the factors led to their marginalization and passive role in society the origin of declining citizenship rights can pave the way to take a comprehensive outlook to the necessity of providing legislative measurements to protect this range of citizens. With pondering the new approaches in the area of citizenship rights the author tries to review preventive and protective measures in the benefit of people living with HIV/AIDS with making clear the manifestations of citizenship rights based on humanitarian rights doctrines including right to job opportunities right to accessing treatment and health services, right to movement and right to privacy.
