fa معیارهای بهینه‌سازی مقررات محدودیت‌ها و استثنائات در نظام حقوق مالکیت ادبی و هنری پژوهشي Original Article <p dir="RTL">محدودیت‌ها و استثنائات وارد بر حقوق مالکیت ادبی و هنری و حقوق مرتبط یکی از موضوعات پرچالش و جذاب حقوق مالکیت فکری به شمار می‌آید و با هدف درک جایگاه منافع عمومی در نظام حقوقی وضع می‌شوند.</p> <p dir="RTL">این محدودیت‌ها و استثنائات دارای اقسام مختلفی مانند استفاده کتابخانه‌ای، استفاده آموزشی، نقل و... هستند، اما در مقام اجرای آن‌ها، نیاز به معیاری جامع و مانع برای ایجاد موازنه میان جامعه و صاحب حق وجود دارد.</p> <p dir="RTL">در این میان، معاهدات بین‌المللی و نظام‌های ملی تلاش می‌نمایند با معیارهای آزمون سه گام و استفاده منصفانه، قواعد و هنجارهای ضروری این موازنه را فراهم نمایند. عضویت قریب‌الوقوع ایران در سازمان تجارت جهانی و متعاقباً الحاق به موافقت‌نامه تریپس و همچنین کنوانسیون برن که زمینه‌های مساعد پیوستن به آن ایجاد گردیده و برگزاری شش دوره همایش‌های ملی حقوق مالکیت ادبی و هنری که انگیزه عضویت را فزون‌تر نموده و ضرورت دستیابی به نظام منسجم حقوق مالکیت فکری مطابق با سند چشم‌انداز بیست‌ساله و نقشه جامع علمی کشور از سوی دیگر موجب گشته بررسی معیار بهینه‌سازی محدودیت‌ها و استثنائات متناسب با نظام ملی به مسئله ای مهم تبدیل شود. مقاله حاضر براساس رویکرد تحلیلی ـ توصیفی و روش کتابخانه‌ای و بعضاً میدانی در پی واکاوی معیارهای مناسب برای استفاده بهینه از محدودیت‌ها و استثنائات است و سرانجام نتیجه‌گیری می‌نماید که رویکرد ترکیبی از معیارهای موجود مناسب خواهد بود.</p> <p>The limitations and exceptions on the copyright and related rights is one of the most challenging and interesting issues of intellectual property rights and legislated with the aim of understanding of the public interest in the legal system.</p> <p>These limitations and exceptions has different categories such as library use, educational use, and so on, but as their implementation, there is the need for comprehensive criteria to create a balance between the community and the owner right.</p> <p>In the meantime, international treaties and national systems is trying to provide the balance by the three-step test and the fair use criteria. Iran&#39;s imminent membership in the WTO and TRIPS Agreement and the subsequent accession to the Berne Convention, the holding six national conferences literary and artistic property rights and the need to achieve coherent system of intellectual property rights in accordance with the vision twenty years document and Scientific Holistic Map to optimize the standard of limitations and exceptions has become a Question. The recent paper attempts to study appropriate criteria in a descriptive-analytical way.
