fa حقوق مالکیت هنری و بازار هنر نگاهی به هنر معاصر ایران و برخی چالش ‌های حقوقی آن <p dir="RTL">هنر، هسته مرکزی صنایع خلاق است<a href="#_edn1" name="_ednref1" title=""><span dir="LTR">[1]</span></a> و کل فعالیت‌های این صنایع بر اساس نحوه ارتباط‌شان با حقوق مالکیت هنری دسته‌بندی می‌شوند. موضوعات امروز بازار جهانی هنر، تنها خرید و فروش آثار هنری، به عنوان دارایی نیست، بلکه خرید و فروش حقوق نشر و حق امتیازها هم هست. در واقع تجارت جهانی هنر به دو بخش دارایی‌های سرمایه‌ای ملموس<a href="#_edn2" name="_ednref2" title=""><span dir="LTR">[2]</span></a> (آثار هنری) و ناملموس (حقوق مالکیت) تقسیم شده است و جالب توجه این‌که درآمدهای حاصل از فروش دارایی‌های ناملموس بیشتر است. در حال حاضر هنر معاصر مهم‌ترین شیوه تولید هنری در دنیای هنر به شمار می‌رود و بنا به ویژگی‌های منحصر به فردش چالش‌هایی جدی برای بسیاری از علوم مرتبط از جمله حقوق مالکیت هنری به همراه داشته است. این چالش‌ها به سبب وضعیت ویژه کشور ما حادتر هم شده‌اند. این نوشته برای مطالعه این مسائل در چهار فراز کلی صورت‌بندی شده است ابتدا به اختصار بازار هنر و تحولات آن مطرح می‌شود، سپس برخی از چالش‌های مهم حقوق مالکیت هنری در هنر معاصر گفته می‌شود و بعد از آن به وضعیت ویژه‌ ایران و نیز مشکلاتی می‌پردازیم که در اثر نپذیرفتن ترتیبات جهانی برای هنر معاصر ایران رخ می‌دهد در پایان هم ضمن جمع‌بندی توصیه‌هایی برای سیاستگذاران و هنرمندان خواهیم آورد.</p> <div>&nbsp; <hr align="left" size="1" width="33%" > <div id="edn1"> <p dir="RTL"><strong>پی‌نوشت‌ها</strong></p> <p>[1]. Intangible Capital Asset</p> </div> </div> <p>Art is the central core of creative industries and all the activities in these industries are categorized according to their relation to copyright. What matters in the today&#39;s world art market is not just buying and selling of artworks as an asset class, but also buying and selling the copyright. In fact, world trade in the arts is divided into tangible assets (works of art) and intangible assets (property rights); interestingly, the income gained out of selling intangible assets is greater than that of the tangible ones.</p> <p>Contemporary art is considered the most important trend in today&rsquo;s art world. Because of its unique features, it has created serious challenges for several related fields of study including intellectual property rights. These challenges have been intensified by the particular situation of Iran. To study these topics, this paper is arranged in four main parts. First, it briefly deals with the art market and its developments. Some considerable challenges to the intellectual property rights in the contemporary art are discussed afterwards. Then, it addresses the peculiar circumstances of Iran and the problems faced by the Iranian contemporary art as a result of not accepting the international arrangements.
