fa آسیب‌شناسی تحقق اهداف اصلاحی ـ درمانی بزه‌کاران از طریق پرونده شخصیت در فرایند دادرسی کیفری پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:tahoma;">پیش‌بینی پرونده شخصیت در قانون آیین دادرسی کیفری 1392 (اصلاحی 1394 ش.) و تأکید بر اجرای آن در قانون برنامه ششم توسعه کشور مصوب 1395 در حالی است که ابهامات متعددی در رابطه با شیوه تشکیل، پیاده‌سازی و چگونگی ارتباط میان حقوق و علم پزشکی وجود دارد. با توجه به هدف پرونده شخصیت، یعنی مجازات برای اصلاح بزه‌کار و درمان وی، لذا ضرورت دارد تا با ملاحظه قانون و فرآیند قضایی، ابهامات پیاده‌سازی حقوقی ـ پزشکی پرونده شخصیت تبیین گردد: مؤلفه‌های مهم درمانی ـ اصلاحی در پرونده شخصیت بزه‌کار کدامند و با چه شیوه‌ها و تحقیقاتی باید آن‌ها را استخراج نمود؟ از سوی دیگر در فرآیند دادرسی کیفری نگرش اصلاحی درمانی ناظر به پرونده شخصیت و پیاده‌کردن آن با چه چالش‌هایی رو به رو است؟ این مقاله در نتیجه مطالعه کتابخانه‌ای و در برخی موارد پیمایشی مبتنی بر مشاهده فرآیند قضایی، در پنج قسمت به ترتیب به مؤلفه‌های پرونده شخصیت بزه‌کار، شیوه تحقیق و نوع آن، مراحل مهم قضایی و چالش‌های اجرایی‌شدن آن می‌پردازد. نتیجه آنکه، نبود افراد متخصص در تشکیل و جمع‌آوری اطلاعات لازم در پرونده شخصیت از یکسو و همچنین اختصار بیش از حد فرآیند تشکیل آن از سوی دیگر، باعث شده است که تشکیل پرونده شخصیت صبغه‌ای اداری و غیر تخصصی به خود بگیرد و عوامل مهمی چون عدم اختصاص بودجه‌های مرتبط، پیاده‌سازی اهداف اصلاحی و درمانی بزه‌کار را با چالش جدی مواجه سازند. به همین منظور در این مقاله با ترسیم نظام‌مند جزئیات و راه‌کارهای مرتبط، در راستای تقویت تحقق اهداف اصلاحی ـ درمانی تلاش شده است.</span></div> <div style="text-align: justify;">One of the important innovations of the 1392 criminal Procedure Code (Reformed in 1394) is the recognition of a person&#39;s case file; the implementation of which in the criminal prosecution process reveals the deep link between law and medical science. Looking at the legal material in the case file, one can conclude that the purpose of the victim&#39;s correction and treatment, especially in the process of determining the punishment, is one of the basic goals of this institution. Nevertheless, considering the text of the law and the judicial process, the pathology of the various areas that influence the implementation of medical law-based medical records puts forward important questions, such as: What are the important corrective factors in the criminal case file? What practices and research should they extract? On the other hand, what are the challenges faced by the criminal procedure in the process of criminological treatment of a person&#39;s case file and its implementation? The same questions indicate that the two-dimensional approach from the legal and medical point of view will make the subject matter more relevant.<br> According to the considerations mentioned in the article, which are the result of a library study and in some cases, a survey based on the observation of the judicial process, it can be stated that the lack of specialists in the collection and compilation of the necessary information in the case file On the one hand, as well as the excessive shortening of the process of its formation, on the other hand, has led to the filing of an administrative and non-specialist personality and the important factors, such as the non-allocation of related budgets, the implementation of corrective and delinquent goals, with Challenges.
