fa امکان‌سنجی ثبت دارو‌های پلی‌مرف به عنوان اختراع در حقوق ایران و آمریکا پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL">عنوان پلی‌مرف به دارو‌هایی اطلاق می‌گردد که با فرمول شیمیایی واحد، آرایش کریستالی متفاوتی در مولکول‌های سازنده داشته و این مسأله در سرعت انحلال دارو و ورود آن به فاز مایع مؤثر است. از آنجا که اشکال پلی‌مرف جدید دارو‌های موجود، می‌توانند دارای اثرات بهتر و باارزش‌تری باشند، حق اختراع شکل پلی‌مرف این داروها نیز بالقوه ارزش اقتصادی داشته و رقابت بر سر</span> <span dir="RTL">ثبت آن با توجه به قوانین حمایت از حقوق مالکیت فکری صاحبان اثر، در میان تولیدکنندگان شکل پلی‌مرف ثانویه آن بالا است. از این رو و در این بین، خلأ قانونی برای رفع این نزاع میان دو دسته فوق مشاهده می‌شود. این پژوهش برای رفع خلأ قانونی موجود، ضمن مطالعه تطبیقی وضعیت کنونی نظام حقوقی ایران با مقررات و رویه عملی کشور آمریکا درصدد پاسخگویی به این سؤال است که آیا در اشکال مختلف یک داروی پلی‌مرف، امکان ثبت جداگانه حق اختراع هر کدام وجود دارد؟ فرضیه اثبات‌شده مقاله حاضر این است که از آنجا که اقدام مبدعان فرم جدید داروی پلی‌مرف از ویژگی‌های قانونی اختراعات از جمله رفع نیاز و نوآوری برخوردار است، امکان ثبت حق اختراع مستقل برای آن وجود دارد. مطالب پژوهش حاضر بر <span style="letter-spacing:-.2pt;">اساس روش کتابخانه‌ای و میدانی در دو بخش ارائه می‌گردد: در بخش نخست، به تبیین مفهوم پلی‌مرفیسم</span> و بررسی مبانی موافقان و مخالفان حمایت می‌پردازیم؛ در بخش دوم جایگاه موضوع در حقوق ایران و آمریکا را نظاره هستیم و در پایان راه‌کار‌های روشنی به قانونگذار عرضه می‌داریم.</span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;">Drug polymorphs are defined as a different arrangement of the same active compounds in crystalline form, which can potentially affect its therapeutic activity by changing the dissolution profile of drug upon administration. Discovery of new polymorphs therefore can provide added value for a previously marketed drug, due to the new advantages provided by the novel polymorph. Therefore, there is an extensive ongoing investigation to find and patent new polymorphs among pharmaceutical companies, which highlights the importance of secondary patenting regulations. In this article, the patenting regulations in the US regarding the secondary patenting are investigated. It is generally accepted that finding new polymorph possesses general requirements for intellectual property right registration. Two methods have been used for this study including library search and field investigation. Firstly the basic knowledge about polymorphism is noted and the views of supporters and opponents are discussed. Then the status of polymorph patenting in the Iranian and the US regulation are explained.
