fa تسهیل دسترسی به دارو برای کشورهای در حال توسعه و کم‌تر توسعه‌یافته توسط سازمان تجارت جهانی با تأکید بر آخرین تحولات موافقت‌نامه تریپس پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;">امروزه با افزایش بیماری‌های گوناگون، زندگی جوامع بشری بیش از پیش با خطر مواجه است. از این رو صنعت داروسازی یکی از مهم‌ترین صنایعی است که باید مورد حمایت قرار بگیرد تا انگیزه برای ابداع داروهای جدید برای بیماری‌های خطرناک و نوظهور و همینطور انگیزه برای تولید وسیع این <span style="letter-spacing:-.1pt;">داروها برای مخترعین و شرکت‌های سرمایه‌گذار در این صنعت حفظ شود. در مقابل مزیت‌های انکارناپذیر</span> حمایت از مخترعین و تولیدکنندگان دارو، این حمایت می‌تواند موجب گردد برخی کشورها بالاخص کشورهای در حال توسعه و کم‌تر توسعه‌یافته، با تهدیدات جدی نسبت به بهداشت عمومی و عدم امکان دسترسی به داروهای تحت حمایت حقوق مالکیت فکری، رو به رو شوند. در این مواقع کدام یک از این دو مصلحت بر دیگری ارجحیت دارد؟ حمایت از صنایع دارویی و یا حفاظت از بهداشت عمومی جوامع در مقابل تهدیدات؟ بر همین اساس این مقاله، تسهیل دسترسی به دارو برای کشورهای در حال توسعه و کم‌تر توسعه‌یافته را توسط سازمان تجارت جهانی، با تأکید بر تحولات معاهده تریپس بررسی کرده است. اجمالاً باید گفت در کنار سازمان بهداشت جهانی که وظیفه‌اش کمک به حفظ سلامت است، سازمان تجارت جهانی تلاش کرده است از طریق درج برخی مواد در موافقت‌نامه تریپس و همچنین &laquo;اصلاح&raquo; آن، ضمن حفظ اصول بنیادین خود نظیر آزادی تجارت و اصل عدم تبعیض، از بهداشت عمومی جوامع در مقابل تهدیدات حمایت کند تا از این طریق از تعارض بین این دو امر حیاتی جلوگیری کند. </span></span></div> <div style="text-align: justify;">Today, with the rise of various diseases, the lives of human societies are more and more endangered. Therefore, the pharmaceutical industry is one of the most important industries to be supported in order to maintain the incentive to invent new drugs for dangerous and emerging diseases, as well as the incentive to produce widespread pharmaceuticals for inventors and investment companies in the industry. Against the undeniable advantages of protecting inventors and drug manufacturers, this support can lead to the emergence of some countries, especially developing and least developed countries, with serious threats to public health and the inability to access proprietary drugs, they face. Which of these two options is preferred over the other? Protecting the pharmaceutical industry or protecting public health against threats? Accordingly, the paper examines the World Trade Organization&#39;s Facilitation of Drug Access for Developing Countries and least developed countries with emphasis on developments in the Trips Treaty. In short, along with the World Health Organization, whose role is to help maintain health, the World Trade Organization has tried to incorporate some of the acts in the trips agreement as well as its &quot;reform&quot;, while maintaining its fundamental principles, such as freedom of trade and the principle of non-discrimination, to protect public health from threats, in order to prevent the conflict between the two.<br> <br> Please cite this article as: Pilvar R, Hosseini Balouchi M.
