fa قواعد حاکم بر اجرای مجازات درباره جنایت دوقلوی به هم چسبیده در حقوق ایران و فقه امامیه پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;"><span dir="RTL">یکی از موضوعات چالشی در موازین فقه امامیه و به ویژه حقوق ایران، مسأله امکان و یا عدم امکان اجرای مجازات بر جنایت ارتکابی توسط دوقلوی چسبیده است که این موضوع بر دو محور امکان و یا عدم امکان جداسازی آنان با لحاظ قابلیت صدور دستور جداسازی آنان از یکدیگر در حالات گوناگونی <span style="letter-spacing:-.1pt;">چون 1ـ امکان جداسازی آن‌ها از یکدیگر، ولی با وجود رضایت، یا عدم رضایت یکی و یا هر دو؛ 2ـ</span> مداخله یکی و یا هر دو در وقوع جنایت در فروض مختلف؛ 3ـ ضمانت اجرای عدم اعمال مجازات بر دوقلوی به هم چسبیده قابل طرح است. یافته‌ها نشان داده است اولاً دادگاه در فرض امکان جداسازی و عدم خطر جسمی ولو عدم رضایت آنان می‌تواند دستور جداسازی آنان را صادر کند؛ ثانیاً در صورت عدم امکان اجرای مجازات حبس بدل از قصاص و عدم امکان جداسازی آنان، مجازات جایگزین پیش‌بینی نشده است؛ ثالثاً در فرض عدم امکان جداسازی دوقلوی به هم چسبیده از یکدیگر در حالت مداخله یکی از آنان در جنایت و عدم امکان تبدیل و یا اعمال مجازات به تنهایی، امکان جداسازی وجود ندارد؛ رابعاً در صورت اجازه هر دو بر اجرای مجازات در فرض مداخله یکی در جنایت و عدم امکان جداسازی، نمی‌توان دستور اجرای مجازات را صادر کرد، لذا در موارد اخیر به جهت تحقق خوف و تغریر و حرج به نفس دیگری همچون موارد عسر مماثلث و احتمال سرایت و زیادتی در قصاص، دیه متعین است.</span></span></span></div> <div style="text-align: justify;">One of the challenging issues in the principles of jurisprudence and especially the rights of Iran, the question of the possibility or impossibility of carrying out the punishment on crimes committed by twin attached to this issue on two axes: the possibility or impossibility of separating them in terms of ordering the separation of the Clinging can be done.<br> The findings have shown that, firstly, the court can assume the possibility of separating them in the assumption of the possibility of separation and the lack of physical security, even if they are dissatisfied with them.
