fa ماهیت و صلاحیت‌های کمیسیون ماده 20 با تمرکز بر نظام حقوقی داروخانه‌ها در پرتو رویه قضایی دیوان عدالت اداری پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;">برخلاف گذشته، در حال حاضر افراد همواره تحت راهبری‌های دولت قرار دارند و یکی از حوزه‌هایی که به طور فزآینده‌ای موضوع دخالت دولت قرار گرفته است، موضوع بهداشت و سلامت عمومی می‌باشد، که مبنای آن تکلیف دولت‌های مدرن برای تضمین بهداشت و سلامت افراد در پرتو حق‌های بشری و کرامت انسانی است. در ایران بخش اعظمی از نظارت دولت در حوزه بهداشت و سلامت عمومی از طریق کمیسیون موضوع ماده 20 قانون مربوط به به مقررات امور پزشکی و دارویی و مواد خوردنی و آشامیدنی مصوب 1334 (با اصلاحات بعدی) اعمال می‌شود. این کمیسیون بر اساس صلاحیت تشخیصی دولت از طریق نظارت پیشینی مرجع صدور پروانه تأسیس و ارزیابی صلاحیت عمومی و فنی مؤسسین و مسؤول فنی مؤسسات پزشکی می‌باشد. افزون بر آن کمیسیون یادشده به عنوان یک مرجع اداری شبه‌قضایی به طور استثنایی صلاحیت اتخاذ تصمیم و صدور رأی در مورد برخی تخلفات مربوط به مؤسسات پزشکی را دارد و می‌توان آن را در زمینه اموری که در آن صلاحیت تشخیص، نظارت و اتخاذ تصمیم دارد، ضابط قضایی خاص نیز به شمار آورد.</span></span></div> <div style="text-align: justify;"><span style="font-size:12px;">Unlike in the past, people are always under leadership of government and one of the most frequent areas of state intervention based on the responsibility of modern governments in the light of human right and dignity is the public health issue. In Iran, a large part of government supervision in the field of public health is exercised by the Commission on the subject of Article 20 of the Code relating to the medical, pharmaceutical, food and drink matters adopted in 1334 (with subsequent amendments). This commission based on the state&#39;s distinctive power through the prior supervision is the authority to establish and evaluate the general and technical competence of the founders and technical authorities of the medical institutions. In addition, the commission as a quasi-judicial administrative authority exceptionally has the authority to make a decision on certain violations of medical institutions and in cases which has competent to discriminate, monitor and decide can be considered as special judiciary bailiffs.<br> <br> Please cite this article as: Vahedi Z, Sheibani A, Bidar Z.
