La déclaration de Tokyo, adoptée par la 29eme Assemblée mondiale, en octobre 1975 , invite a établir une distinction fondamentale entre: D’une part une recherche a but essentiellement diagnostique ou thérapeutique a l’égard du patient.D'autre part une recherche dont l’objet essentiel est purement scientifique et sans finalité diagnostique ou thérapeutique directe a l’égard du patient. Seule la Seconde intéresse véritablement notre propos d’au jour- d’hui, dans la mesure ou la première ne soulève guère de problèmes juridiques ou éthiques. La finalité curative de la première suffit a la faire entrer dans le champ du contrat de soins, dont le régime juridique est bien connu. Définition du mot Droit, en second lieu. Sa signification fait davantage problème, au regard de l’esprit général de cette journée.
Indépendamment des différents sens du mot, tels qu’on les enseigne aux étudiants qui pénètrent dans cet amphithéâtre pour leur l'er cours, je me suis demande si la distinction était toujours bien faite entre Droit, loi et Justice? Dans son sens objectif, qui signifie “I 'ensemble des règles régissant la vie en société, sanctionnées par la puissance publique” la confusion est parfois faite (pour ne pas dire l’amalgame) avec la loi qui en constitue la source principale, et la justice qui en assure le respect, en disant ce qui est juste, dans une espèce concrète. Ce rappel, d’une évidente banalité, a seulement pour objet de bien fixer les rôles respectifs de chacun de ces concepts , pour les besoins de la discussion.
Au regard des problèmes soulèves par la recherche biomédicale, “toute question nouvelle est présentée comme relevant a la fois de l’éthique et du droit, voire pour certains de la déontologie”. Ainsi apparaitrait une zone commune , baptisée “juridico-éthique”. Le rapprochement ne va pas de soi: La norme juridique est assortie d’une sanction sociale organisée, alors que la norme éthique en est dépourvue et relève seulement de la conscience(2) .C’est en quoi, si l’on veut bien nous épargner le soin de ce rappel, la différence entre éthique et morale n’aurait que l’épaisseur… d’un américanisme , dont les gerces se seraient rendus complices. Sauf a considérer, avec Michel
Serres, que l’éthique concerne plutôt “des réflexions de type moral en relation avec les sciences humaines et juridiques’ , alors que la morale concernerait plutôt “ les aspects normatifs, théoriques et formels de ce type de réflexions”.

Medical assisted suicide for people with disability; A challenge on the right to death in criminal law

Medical assisted suicide is a quarrelsome debate among lawyers, criminologists, protective movements advocating the disabled persons and the disabled themselves at the part of vulnerable population. In all these disputes, the centre of gravity is around the right of disabled person to death. Do the disabled themselves select such a right and apply it? Is it a mere right in itself? That is, can we see the manifestation of the disable's free will or undue social discrimination leaves no way for them except selecting death? In case of our accepting it, is it selection based on the disabled actual consent or is it a defective one and arise from social pressure and lack of necessarily lawful protections from this range of vulnerable persons? Is this the lack of the least degree of right for the disabled that lead them toward selections assisted suicide?
Can we condemn the disabled in the circumstances in which their unavoidable fate is nothing but tolerating suffer raised from lethal and incurable disease and finally death? It seems that it was the time to regulate this fact legitimating assisted suicide and adopting legal safeguards in order to recognize the right to resorting assisted suicide although in exceptional circumstances and from the legal viewpoint and the meanwhile replacing the right to voluntary death by the right to select a respectable life. The author tries to deal with the above mentioned issues and discuss the challenges which we face in legitimating assisted suicide.

Protection of Employment Rights of HIV/AIDS Victims Developments and Procedures

HIV/AIDS as a crisis for modern human has influenced on his life in different aspects of personal or social. Reviewing of influences of this situation on employment rights of related victims is important, not only for its epidemic in work places area but also for its potential danger for fundamental human rights. Ensuring the victims right to freedom of any discrimination on their HIV/AIDS situation, may prevent of them deprivation of any promotion, use of insurance, appropriate education and etc as other employees. By employees, I mean workers and other members of government or private section.In this article, I review legal movement to elimination or reduction of negative effect of HIV/AIDS situation on the employment field, through legal texts in international, regional and national levels. So, a number of international decrees, specially IlO’s Code of Practices and a few regional documents in American or African countries, beside some national enactments, have been analyzed. A collection of judicial jurisprudences have used, too. Additionally, I review some scopes of protected employment rights and their related functional ensuring.

Le Sida et les Droits de l’Homme à travers des arrêts de la CEDH

Le malade contaminé par le Sida subit une double souffrance: souffrance physique tout d’abord, du fait des douleurs provoquées par sa maladie, douleur morale et sociale enfin, en raison des attitudes de rejet dont il est l'objet de la part des personnes effrayées par le virus. Le Sida demeure encore un sujet tabou dans plusieurs pays. Ce qui se traduit souvent par un non-respect des droits de l'individu contaminé, voir même l’existence d’une sorte de discrimination à son encontre.
Aujourd’hui, la protection des Droits de l’Homme est inscrite dans plusieurs conventions internationales et régionales, dont celle de la Convention Européenne des Droits de l’Homme, qui nous paraît la plus significative. Cette Convention, avec la Cour Européenne des Droits de l’Homme, l’institution garante de la Convention, doublée d'une jurisprudence de plus d’un demi-siècle, assure une meilleure protection en matière de Droits de l’Homme. Il revient donc à la CEDH de développer son "bouclier juridique" afin de mieux protéger les personnes contaminées par le virus.
Néanmoins nous montrerons dans cet article l’existence de certains arrêts qui illustrent une politique en décalage avec celle de la Convention et des arrêts antérieurs. Ce fait est en particulier aisément décelable en matière d’éloignement forcé des étrangers contaminés. À nos yeux, il serait donc préférable pour la CEDH de prendre des décisions plus harmonieuses avec les principes originels en considérant davantage la dure situation de ces malades. C’est ainsi que le respect des droits des malades du Sida sera garanti.

This article, first represents statistics of AIDS in Iran and the world, then studies the feature of AIDS disease, the factors of infection and the ways of its transmission. In this article we regards to the special group such as children, women and prisoners. Moreover some issues related to the observation of human rights principle in respect of HIV-positive persons are discussed.
The next section dedicated to criminal liability to transmission of HIV where the arguments for and against criminalization of HIV transmission would be discussed. In Iranian penal code there are some suitable criminal subjects like murder, attempt murder and transmission of STD to apply in respected behaviors. Abortion of HIV positive fetus would also be forbidden in both Islamic rules and penal code. The final section discusses civil liability of physicians and nurses through transmission of HIV to patient and results that all damages suffered by victim should be compensated.

Development of human science and technology and its effect on human feature requires the necessity of lawyer`s attention to this development. The predetermination of a child’s gender technology is one of this development that place in the medical law scope. At first this article explains the medical aspect of this technology and then it tries to legally analyze the predetermination of a child’s gender technology by Survey the deferent legal viewpoint and their reasoning.
This research tries to answer this question that if the predetermination of a child’s gender technology is a discriminatory and misanthropic method. What is the effect of this technology in society? The outcome of this article is the necessity of special attention to this matter because of the preference of male child in the society, changing of population structure and subsequent social problems. In addition legislators must follow the control and reduction policy in this matter.
