The importance of law and the responsibility of producers of blood toward the recipients can best be seen in the tragic event for “Hemophiliacs” patients. In fact, third tragedy is full of highly important judicial documents that cover different earaches of law, as the law of civil responsibility has been the basis of the trial. The civil responsibility of the state toward the citizens is a domain of responsibility that is especially apparent in those fields in which the state has the exclusive control. Sinus the objective of the civil responsibility system, is to prevent malpractice reparation of damage, and distribution of the financial expenses in the so city, we can easily explain the civil responsibility of states. Hepatitis C and AIDS patients have??? Basic rights as human beings and discrimination against these patients is a violation of these basic rights. Assuming the direct role of the state in the management of medical procedures in public hospitals and the possibility of the direct role of the state in their affliction and regarding the role of the state in public health, the major issue is the basis of civil responsibility et the state in these diseases, which is the objective of the authors in the article.
