fa بررسی سیاست تقنینی ایران درحمایت از حقوق شهروندی با تأکید بر حق برابری سلامت پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;"><span style="color:black;">زمینه و هدف:</span></span></strong> حق برابری در سلامت، حقی مهم در حفاظت از حقوق شهروندی است که در قوانین بسیاری از کشورها به آن اشاره شده است. مسئله اساسی این است که علی&shy;رغم اهمیت موضوع و درج آن در قوانین و مقررات داخلی و بین &shy;المللی، توجه به این حق که نقش مهمی در ارتقای سلامت عمومی و اعتماد جامعه نسبت به دولت دارد بسیار کم رنگ است. به نظر می &shy;رسد نادیده گرقتن حقوق مردم در برابری سلامت و درمان ناشی از عدم آگاهی از قوانین موضوعه است. از این رو هدف اساسی پژوهش حاضر، بررسی مفهوم و جایگاه حق بر سلامت در حقوق ایران و مشخص گردیدن ضمانت اجرای عدم توجه به آن می&shy; باشد.<span style="font-size:11.0pt;"></span><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این پژوهش از نوع نظری بوده و با روش توصیفی- تحلیلی تهیه شده است. همچنین روش جمع&shy; آوری اطلاعات به صورت کتابخانه&shy; ای و با مراجعه به اسناد، قوانین تصویب گردیده و مقالات حقوقی است<strong>.</strong></span><strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.0pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;"><span style="color:black;">یافته‌ها: </span></span></strong>یافته&shy; ها حاکی از آن است که حق بر سلامت به عنوان یکی از مهمترین موضوعات حقوقی در قوانین و مقررات به کرات مورد اشاره قرار گرفته است. موضوعی که عدم توجه به آن مصوبات می&shy; تواند افراد را در معرض تعقیب کیفری قرار دهد<strong>.</strong><span style="font-size:11.0pt;"></span><br> <strong><span style="letter-spacing:-.1pt;"><span style="color:black;">ملاحظات اخلاقی:</span></span></strong> تمامی اصول اخلاقی شامل اصالت متن، صداقت، امانت&shy;داری و اجرای قوانین در تهیه این پژوهش رعایت شده است.<span style="letter-spacing:-.1pt;"><span style="color:black;"><span style="font-size:11.0pt;"></span></span></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;"><span style="color:black;">نتیجه‌گیری:</span></span></strong> <span dir="RTL">برابری در ارایه خدمات سلامت به تمامی مردم به عنوان حقی اساسی، از مهمترین مصادیق حقوق بشری است که توجه به آن توسط کشورها حاکی از حکمرانی خوب است. با بررسی سیاست تقنینی ایران مشاهده می&shy;شود، گرچه قانون‌گذار مقرراتی در خصوص حق برابری سلامت تصویب کرده است، اما در عمل در ارتباط با برخی از شاخص ها، تناقضات و تفاوت&shy; هایی مشاهده می&shy; شود و فقدان عدالت در سلامت و نابرابری در دسترسی به خدمات سلامت همچنان بالا است.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The right to equality in health as an important principle that protects civil rights, which is enshrined in the laws of many countries. The bottom line is that despite the importance of the issue and its inclusion in domestic and international law, attention to this right, which plays an important role in promoting public health and public confidence in the government, is very low. It seems that the disregard for the rights of the people in the equality of health and treatment is due to the lack of knowledge of the relevant laws.&nbsp; Therefore, it is necessary to review those concepts and rules and determine the criminal sanction<span dir="RTL"></span><br> &nbsp;<br> <strong>Materials and Methods: </strong>This Research has Been Prepared by Descriptive-Analytical Method and its Data has Been Collected by Documentary-Library Tools.<span dir="RTL"></span><br> &nbsp;<br> <strong>Results:</strong> Findings indicate that the right to health has been repeatedly mentioned as one of the most important legal issues in laws and regulations. An issue that ignoring it can expose individuals to criminal prosecution.<span dir="RTL"></span><br> &nbsp;<br> <strong>Ethical Considerations: </strong>In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.<span dir="RTL"></span><br> &nbsp;<br> <strong>Conclusion:</strong> Equality in providing health services for all people as a fundamental right is one of the most important examples of human rights, which paying attention to it by countries indicates good governance.
