fa آسیب‌شناسی حمایت حقوقی مطلوب از بزه‌دیدگان سالمند در نظام کیفری ایران (با نگاهی به اسناد بین‌المللی و حقوق امریکا) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong><span style="color:black;"> امروزه در اثر مطالعات گسترده‌ای که پیرامون بزه‌دیده، به عنوان دیگر کنشگر پدیده مجرمانه صورت گرفته و همچنین با ظهور علم بزه‌دیده‌شناسی، بزه‌دیده دیگر به عنوان رکن مخفی جرائم به شمار نمی‌آید و جایگاه واقعی و حق وی در حاشیه نیست. از این رو شاهد رویکرد متفاوتی نسبت به قربانیان جرم، خاصه سالمندان بزه‌دیده از گذشته می‌باشیم. این مطالعات نیز طیف گسترده و متنوعی را شامل می‌شود که اجمالاً </span>عبارت است از: تأثیر خود بزه‌دیده <span style="color:black;">در فرایند تحقق امر مجرمانه تا پرداختن به این بحث که او پس از بزه‌دیدگی به چه حمایت‌هایی نیازمند است.</span><span dir="LTR"><span style="color:black;"><span style="font-family:Times New Roman,serif;"></span></span></span><br> <strong>مواد و روش‌ها:</strong><span style="color:black;"> نگارندگان با توجه به عدم وجود تحقیقی جامع و مانع در خصوص حمایت از بزه‌دیدگان سالمند و خاصه بررسی تطبیقی آن با کشور آمریکا که دارای نوآوری است، در نوشتار پیش رو با استفاده از روش توصیفی ـ تحلیلی، حمایت حقوقی مطلوب از بزه‌دیدگان سالمند را در نظام کیفری ایران با نگاهی به اسناد بین‌المللی و حقوق امریکا مورد تبیین و ارزیابی قرار داده‌اند.</span><br> <strong>یافته‌ها:</strong><span style="color:black;"> بنابراین یافته‌های پژوهش پیش رو پیرامون حمایت از بزه‌دیدگان سالمند، چشم‌انداز جدیدی در حقوق اکثر کشورها بوده است که تأثیرگذاری انگیزه‌های اخلاقی و ایدئولوژیکی بر بزه‌دیده‌شناسی را فراروی بزه‌دیده‌شناسان گشوده است، لذا از آنجایی ‌که آسیب‌پذیری اجتماعی اشخاص سالمند نسبت به پدیده‌های مجرمانه بیشتر بوده، اقتضا می‌کند تا میزان حمایت تقنینی، قضایی و اجرایی از سالمندان قربانی خشونت نیز وسیع‌تر باشد.</span><br> <strong>ملاحظات اخلاقی:</strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong><span dir="RTL"><span style="color:black;"> در پژوهش حاضر مشاهده خواهد شد تنوع و گوناگونی لایه‌ها و ابعاد سیاست جنایی، در ارتباط با بزه‌دیده‌شناسی حمایتی، این امکان را می‌یابد که به یک ساختار چندبعدی حمایتی منجر شود که اصل و اساس آن را سیاست جنایی تقنینی می‌سازد. از طرفی دیگر نیز در راستای حمایت از حقوق بزه‌دیده در عرصه بین‌الملل، </span></span><span dir="RTL"><span style="color:black;">لزوم تدوین اسناد بیشتر در این خصوص محسوس می‌باشد.</span></span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Today, due to extensive studies on the victim as another actor in the criminal phenomenon, and also with the advent of the science of victimology, the victim is no longer considered as a secret element of crime and his real position and rights are not kept in the margins; Hence, we are witnessing a different approach to the victims of crime, especially the elderly victims of the past. These studies also cover a wide and diverse range, which includes: The victim&#39;s own influence in the process of realizing the crime to address the issue of what support he or she needs after being victimized.<br> <strong>Materials and Methods: </strong>The authors, due to the lack of comprehensive and obstructive research on the protection of elderly victims, and in particular its comparative study with the United States, which has been innovative, In the present article, using a descriptive-analytical method, the desired legal protection of elderly victims in the Iranian penal system is explained and evaluated by looking at international documents and American law.<br> <strong>Findings: </strong>Therefore, the findings of the forthcoming research on the protection of elderly victims are a new perspective in the law of most countries that has opened the impact of moral and ideological motives on victimology to victims. Therefore, since the social vulnerability of the elderly is higher than criminal phenomena, it is necessary that the level of legislative, judicial and executive support for the elderly victims of violence be wider.<br> <strong>Ethical Considerations: </strong>In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion:</strong> In the present study, it will be observed that the diversity of layers and dimensions of criminal policy, in relation to support victimology, makes it possible to lead to a multidimensional support structure Which is based on legislative criminal policy.
