fa تحولات حق بر سلامت در ایران و بین‌الملل (با تأکید برحقوق شهروندی و کووید 19) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="color:black;">زمینه و هدف:</span></strong> حق بر سلامت یکی از مصادیق حقوق طبیعی است که اسلام نیز بر آن تأکید دارد و از عوامل اصلی در ارزیابی توسعه‌یافتگی جوامع محسوب می‌شود و در ذیل نسل دوم حقوق بشر قرار می‌گیرد. بر اساس بند ب ماده 55 منشور ملل متحد، دولت‌ها متعهد به ارائه راه‌حل‌هایی برای غلبه بر مشکلات حوزه سلامت و حمایت از نهادهای تأمین اجتماعی، درمانی و بهداشتی می‌باشند. هدف اصلی پژوهش حاضر، بررسی مفهوم و جایگاه حق بر سلامت در نظام حقوقی ایران و جهان با تأکید بر حقوق شهروندی و پاندمی کووید 19 می‌باشد.<span dir="LTR"><span style="color:black;"><span style="font-size:10.5pt;"></span></span></span><br> <strong>روش پژوهش:</strong> این پژوهش با روش توصیفی - تحلیلی تهیه شده و جمع‌آوری اطلاعات آن نیز با ابزار اسنادی - کتابخانه‌ای صورت گرفته است.<span dir="LTR"><span style="color:black;"><span style="font-size:10.5pt;"></span></span></span><br> <strong>یافته‌ها:</strong> یافته‌ها حکایت از آن دارد که دولت‌ها برای تأمین یک زندگی سالم ملزم به اقداماتی فوری (تهیه دارو) می‌باشند. دولت ایران نیز در اصل 29 قانون اساسی این مسئله را مورد تأیید قرار داده است. همچنین دولت ایران به موجب ماده 25 اعلامیه جهانی حقوق بشر و ماده 12 میثاق حقوق اقتصادی و اجتماعی حق دسترسی به داروهای درمانی را به رسمیت شناخته است.<span dir="LTR"><span style="font-size:10.5pt;"></span></span><br> <strong>ملاحظات اخلاقی:</strong> <span style="color:black;">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><span dir="LTR"><span style="color:black;"><span style="font-size:10.5pt;"></span></span></span><br> <strong>نتیجه‌گیری:</strong> در نظام حقوق بین‌الملل حق بر استحقاق، جزئی از اهداف و تعهد نسبت به آن و یک تعهد سیاسی محسوب می‌شود. بهتر است این حق به مثابه یکی از مصادیق حقوق بشر در نظر گرفته شود. در ایران علی‌رغم وجود برخی قوانین خاص در این زمینه که موجب افزایش برخورداری افراد می‌شود، اما در عمل نتیجه مطلوب حاصل نشده است.<span dir="LTR"><span style="color:black;"><span style="font-size:10.5pt;"></span></span></span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Right to Health is one of the Examples of Natural Rights That Islam Emphasizes it and is one of the Main Factors in Assessing the Development of Societies and is Under the Second Generation of Human Rights. According to Paragraph b of Article 55 of the UN Charter, States Undertake to Provide Solutions to Overcome Health Problems and to Support Social Security, Health and Medical Institutions. The Main Purpose of This Study is to Investigate the Concept and Position of the Right to Health in the Legal System of Iran and the World With Emphasis on Citizenship Rights and the Covid 19.<br> <strong>Research Method:</strong> This Research has Been Prepared by Descriptive-Analytical Method and its Data has Been Collected by Documentary-Library Tools.<br> <strong>Results:</strong> The Findings Suggest that Governments are Required to Take Immediate Action (to Provide Medicine) to Ensure a Healthy Life. The Iranian Government has Also Ratified This Issue in Article 29 of the Constitution. The Iranian Government has Also Recognized the Right of Access to Medicines Under Article 25 of the Universal Declaration of Human Rights and Article 12 of the Covenant on Economic and Social Rights.<br> <strong>Ethical Considerations:</strong> In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.<br> <strong>Conclusion:</strong> In the System of International Law, The Right to Entitlement is Part of the Goals and Commitment to it is a Political Commitment. It is Better to Consider This Right as one of the Examples of Human Rights. In our Country, Despite the Existence of Some Special Laws in This Field That Increase the Enjoyment of People, But in Practice, The Desired Result has not Been Achieved.<br> <br> <strong>Cite this article as: </strong>Rostami S, Jafari A, Rostami S.
