fa حقوق بشر و توسعه حق مشارکت در حیات فرهنگی جامعه در گفتمان‌های حقوقی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> جهان‌شمولی حقوق بشر در آینه تنوع فرهنگی از یک‌سو و حق مشارکت فرهنگی به تبع این تنوع از سوی دیگر دیر زمانی نیست که در بستر تمدن بشریت مورد توجه قرار گرفته است. شاید بتوان آن را مسبوق به زمانی دانست که اعلامیه جهانی حقوق بشر در 1948 مورد تصویب قرار گرفت. این مسأله تا به امروز در سیاست، دکترین و رویه قضایی بین‌المللی همچنان مطرح بوده و هست. هدف ما در این مقاله توسعه حق مشارکت شهروندان در حیات فرهنگی جامعه و پیگیری چالش‌های تقنینی و اجرایی درخصوص توسعه این حق در سطح ملی و بین‌المللی با توجه به اسناد بین‌الملل و نیز مقررات داخلی است.<br> <strong>روش تحقیق:</strong> روش تحقیق در این مقاله به صورت توصیفی - تحلیلی و با استفاده از ابزار فیش‌برداری از منابع کتابخانه‌ای است.<br> <strong>یافته‌ها:</strong> یافته این مقاله عدم رعایت حقوق فرهنگی و نمود مشارکت در حیات فرهنگی است. همچنین مشاهده خواهد شد که اگرچه حقوق بشر در عصر جهانی شدن، حقوق فرهنگی اشخاص را در هر قوم، زبان، نژاد و ... مورد احترام می‌شمارد، لیکن به نظر می‌رسد حاکمیت‌ها این حقوق را آنچنان‌که شایسته است محترم نمی‌شمارند و در پرتو مبانی حقوق انسانی در مواقع لازم به اجرا گذارده نمی‌شوند.<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong><span dir="RTL"> حق مشارکت از جمله مؤلفه‌های حقوق بشر می‌باشد که با نگرش‌های جهانی احیا می‌گردد. برای اینکه این حق را در حیات فرهنگی اجتماع بتوان مورد بازاندیشی قرار داد؛ ناگزیر باید جهان‌شمولی حقوق بشر را تبیین کرد، هرچند یافته تحقیق عدم رعایت حقوق فرهنگی و نمود مشارکت در حیات فرهنگی است؛ اما می‌توان ادعا کرد از منظر تقنین کاستی وجود ندارد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim</strong>: The Universality of Human Rights in the Mirror of Cultural Diversity on the one Hand and the Right to Cultural Participation on the Other Hand Has not Long Been Considered in the Context of Human Civilization. It Can be Traced Back to the Time When the Universal Declaration of Human Rights Was Adopted in 1948. This Issue Has Remained and Continues to This Day in International Politics, Doctrine and Jurisprudence. Our Goal in This Article is to Develop the Right of Citizens to Participate in the Cultural Life of Society and to Pursue Legislative and Executive Challenges Regarding the Development of this Right at the National and International Levels in Accordance With International Instruments as Well as Domestic Regulations<span dir="RTL">.</span><br> <strong>Materials and Methods:</strong> The Research Method is Descriptive-Analytical and by Using Collection Tools of Library Resources.<br> <strong>Findings:</strong> The Finding of This Article is Non Respect of Cultural Rights and the Manifestation of Participation in Cultural Life. It Will Also be Observed That Although Human Rights in the Era of Globalization Respect the Cultural Rights of Individuals in Every Ethnic Group, Language, Race, Etc., But it Seems That the Authorities do not Respect These Rights as They Should and in the Light of the Principles of Human Rights They are not Enforced When it is Necessary.<span dir="RTL"></span><br> <strong>Conclusion:</strong> The Right to Participate is one of the Components of Human Rights That is Revived With Global Attitudes. For This Right to be Reconsidered in the Cultural Life of Society, the Universality of Human Rights Must Inevitably be Explained.
