fa چالش‌ها و محدودیت‌های حقوق بشری فراروی دادرسی‌های کیفری در سایه مطالعات جرم‌شناسی امنیتی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> تضمین رعایت حقوق بشری در قلمرو دادرسی عادلانه؛ رعایت کلیه تضمین‌های شکلی و ماهوی مربوط به حقوق طرفین دعوی را در دادرسی‌های کیفری اقتضاء می‌کند. لیکن امروزه متعاقب افزایش روزافزون آمار جرائم و انحرافات اجتماعی به‌ویژه انواع جرائم تروریستی و امنیتی، شاهد چرخش نگاه حقوق شکلی عدالت‌محور در راستای تأمین امنیت و مبارزه با بزهکاری به نگاه امنیت‌محور می‌باشیم که این خود برگرفته از آموزه‌های جرم‌شناسی نوین است.<span style="font-size:12.0pt;"></span><br> <strong>مواد و روش‌ها:</strong> <span style="color:#0d0d0d;">این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><span style="font-size:12.0pt;"></span><br> <strong>یافته‌ها:</strong> سایه‌افکنی جرم‌شناسی امنیت‌محور بر حقوق کیفری، به‌ویژه حقوق کیفری شکلی، هر آنچه که در یک دادرسی عادلانه با تضمین‌های حقوق بشری متصور بوده را متحول گردانیده و با نادیده انگاشتن اصول و معیارهای دادرسی منصفانه، آیین دادرسی کیفری سخت‌گیرانه‌ای، چه در مرحله تحقیقات مقدماتی و چه در مرحله رسیدگی به منصه ظهور رسانیده است.<span style="font-size:12.0pt;"></span><br> <strong>ملاحظات اخلاقی: </strong>در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت‌داری رعایت شده است.<span style="font-size:12.0pt;"></span><br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong> <span dir="RTL">بی‌توجهی به اصول و قواعد حاکم بر یک دادرسی عادلانه و منصفانه اگرچه به عنوان یک مسکن موقتی اثر خود را به نحو مطلوب بر جای گذاشته لیکن آثار مخربی بر نظم و امنیت جامعه خواهد داشت که به هیچ‌وجه قابل جبران نخواهد بود چراکه آنچه مسلم است هدف حقوق کیفری، ایجاد امنیت در جامعه است</span><span dir="RTL">، اما نباید به هیچ‌وجه مجوزی برای تعدی به ارزش‌های بنیادین و اساسی متهمان و مظنونان گردد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Objective:</strong> Ensuring Respect for Human Rights in the Realm of Fair Trial; Observance of all Formal and Substantive Guarantees Related to the Rights of the Litigants is Required in Criminal Proceedings. However, Today, Following the Increasing Number of Crimes and Social Deviations, Especially Terrorist and Security Crimes, we are Witnessing a Shift in the View of Justice-Oriented Formal Rights in Order to Ensure Security and Fight Crime From a Security-Oriented Perspective, Which is Derived From Modern Criminological Teachings.<br> <strong>Materials and Methods: </strong>This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has been Done by Referring to Documents, Books and Articles.<br> <strong>Findings:</strong> The Shadow of Criminal Law-Based Security Criminology, Especially Criminal Law, Has Transformed Everything Conceived in a Fair Trial with Human Rights Guarantees.
