fa تطبیق حق آزادی در نظام حقوقی اسلام و بین‌الملل در پرتو ماده ۱۹ اعلامیه جهانی حقوق بشر و ماده ۱۸ میثاق حقوق مدنی و سیاسی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> <strong>زمینه و هدف:</strong> احترام به حقوق و آزادی‌های انسان از حقوق بنیادین بشر در تمام نظام‌های حقوقی خاصه نظام حقوقی اسلام می‌باشد. لازمه دستیابی به آزادی بیان که در ماده 19 اعلامیه جهانی حقوق بشر و ماده 18 میثاق بین‌المللی حقوق مدنی و سیاسی مورد اشاره قرار گرفته است مستلزم تأیید نمودن اصول و توجیه مستدل و منطقی می‌باشد. هدف ما در این تحقیق بررسی حق آزادی بیان در حقوق اسلام و بین‌الملل و دستیابی به نقاط قوت و ضعف این حق در دو نظام حقوقی فوق است.<br> <strong>مواد و روش‌ها:</strong> این مقاله به صورت توصیفی - تحلیلی و به روش کتابخانه‌ای تدوین گردیده است.<br> <strong>یافته‌های تحقیق:</strong> یافته‌ها نشان می‌دهد که دو نظام حقوق اسلام و بین‌الملل درخصوص حق آزادی دیدگاههای مشترکی دارند. تعریفی که علمای حقوقی از آزادی بیان ارائه نموده‌اند بدین شرح است: &laquo;آزادی بیان یعنی آزادی در ابراز عقیده، نظر و فکر اعم از اجتماعی، سیاسی، فلسفی یا مذهبی&raquo;. مضافاً اینکه تمام متفکران به این مسأله قائلند که باید آزادی بیان در چارچوب مشخص بوده تا به حقوق دیگران لطمه وارد نیاورد. درواقع آزادی اندیشه و بیان از حقوق حیاتی است که از ابواب گوناگون مذهبی، فلسفی، اجتماعی، اخلاقی، حقوقی و بین‌المللی مورد مطالعه و تحلیل واقع گردیده و در قوانین داخلی و اسناد و پیمان‌های بین‌المللی منعکس شده و مورد امعان نظر قرار گرفته است.<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong><span dir="RTL"> طبق مطالعات انجام شده در تطبیق دو نظام حقوقی اسلام و بین‌الملل درخصوص حق آزادی، هم در حقوق اسلامی و هم در حقوق بین‌الملل، به صورت مشترک حق آزادی را به عنوان یکی از حقوق حیاتی بشریت به حساب می‌آورند و هرچند در این بین تفاوت‌های اندکی هم وجود دارد، لیکن در هر دو نظام حق آزادی، مورد احترام می‌باشد.</span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><strong>Background and Objective:</strong> Respect for Human Rights and Freedoms is one of the Fundamental Human Rights in all Legal Systems, Especially the Islamic legal System. Achieving Freedom of Expression, is Mentioned in Article 19 of the Universal Declaration of Human Rights and Article 18 of the International Covenant on Civil and Political Rights. It Requires the Affirmation of Reasonable Principles and Justifications. Our Aim in This Study is to Examine the Right to Freedom of Expression in Islamic and International Law and to Achieve the Strengths and Weaknesses of This Right in the Above two Legal Systems.<br> <strong>Materials and Methods:</strong> This Article is Descriptive-Analytical and has been Compiled by Library Method.<br> <strong>Findings:</strong> The Findings Show That the two Systems of Islamic law and International Law have Common Views on the Right to Freedom. The Definition of Freedom of Expression Given by Legal Scholars is that &quot;Freedom of Expression Means Freedom to Express one&#39;s Opinion, Whether Social, Political, Philosophical or Religious.&quot; In Addition, all Thinkers Believe That Freedom of Expression Must be Within a Specific Framework so as not to Harm the Rights of Others. In fact, Freedom of Thought and Expression is a Vital Right That has Been Studied and Analyzed From Various Religious, Philosophical, Social, Moral, Legal and International Chapters and has been Reflected and Examined in Domestic Laws, Documents and International Treaties<span dir="RTL">.</span><br> <strong>Conclusion:</strong> According to Studies Conducted in the Implementation of Islamic and International Legal Systems Regarding the Right to Liberty, Both in Islamic Law and in International Law, the Right to Liberty is Jointly Considered as one of the Vital Human Rights and Although in Between There are Slight Differences, But in Both Systems the Right to Liberty is Respected.</span><br> <br> <strong>Please cite this article as:</strong> Alizadeh Y, Rostami S, Masoudi Niya M.
