fa نقش عرف در تطبیق مفاهیم و مصادیق شرعی و کاربرد آن در حقوق شهروندی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> احکام فقهی مفاهیم کلی مرتبط با موضوعاتی است که تعیین آن‌ها بر عهده شارع و استنباط و توضیح آن‌ها وظیفه فقهاست، اما تعریف و تبیین همه موضوعاتی که محتمل احکامند در محدوده رسالت شارع و وظایف فقها نیست؛ بلکه بیشتر موضوعات متخذ از عرف و جامعه است.<br> هدف اصلی در این تحقیق بررسی و تطبیق حقوق شهروندی است که در اثر گسترش جوامع امروزی شکل گرفته و با عرف که یکی از منابع مهم قانونگذاری محسوب می‌شود در ارتباط است.<br> <strong>مواد و روش‌ها:</strong> این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی تحلیلی می‌باشد. روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است که با مراجعه به کتب فقهی و حقوقی صورت گرفته است.<br> <strong>یافته‌ها:</strong> فقها و حقوق‌دانان نقش اعتباری و تعابیر و جایگاه ویژه‌ای برای عرف قائلند. در قانون و شرع گاهی به‌طور صریح و گاه به‌طور ضمنی تشخیص و تطبیق موضوعات به عرف واگذار شده است. بی‌تردید عرف‌، سنت‌ها و رسوم به‌تدریج به ارزش‌های اجتماعی تبدیل شده و یا موجب شکل‌گیری آن‌ها می‌گردند. در اثر این تحول و پیشرفت در جوامع انسانی موضوعات و حقوق جدیدی در ارتباط انسآن‌ها با هم در یک زندگی جمعی و اجتماعی به وجود آمده است که تحت عنوان حقوق شهروندی نامیده می‌شود. در این مقاله سعی بر این است نقش عرف در تطبیق مفاهیم و مصادیق بر موضوعات شکل گرفته تحت عنوان حقوق شهروندی بررسی شود.<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong> <span dir="RTL">حقوق شهروندی مفهوم عامی است که شامل حقوق مدنی و اجتماعی و فردی است و می‌تواند موضوع بسیاری از قوانین قرار بگیرد. از آنجایی که در تعیین و تدوین قوانین از دو منبع شرع و عرف استفاده می‌شود؛ عرف نقش اساسی و مهمی در تدوین قوانین شهروندی و در جایی که قانون مبهم است در تعیین مصادیق و مفاهیم دارد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Jurisprudential Rulings are General Concepts Related to Issues that are the Responsibility of the Shari&#39;a to Determine and Explain Them. But the Definition and Explanation of all the Issues that are Possible Rulings is not Within the Scope of the Mission of the Shari&#39;a and the Duties of the Jurists; Rather Most of the Topics are Taken From Custom and Society.<br> The Main Purpose of This Study is to Investigate Citizenship Rights that Have Been Formed as a Result of the Expansion of Today&#39;s Societies and are Related to Custom, Which is one of the Important Sources of Legislation<span dir="RTL">.</span><br> <strong>Materials and Methods:</strong> This Research is Theoretical and the Research Method is Descriptive-Analytical. The Method of Collecting Information is in the Form of a Library, Which has been Done by Referring to Jurisprudential and Legal Books.<br> <strong>Findings:</strong> Jurists Consider the Role of Credit and Interpretations and a Special Place for Custom. In Law and Sharia, Sometimes Explicitly and Sometimes Implicitly, the Recognition and Application of Issues is Left to Custom. Undoubtedly, Traditions and Customs Gradually Become Social Values or Cause Their Formation. As a Result of this Development in Human Societies, New Issues and Rights have Emerged in the Relationship Between Human Beings in a Collective and Social Life Called Citizenship Rights. This Article Tries to Examine the Role of Custom in Applying Concepts and Examples to the Issues Formed Under the Title of Citizenship Rights.<br> <strong>Conclusion:</strong> Citizenship is a General Concept That Includes Civil, Social and Individual Rights and Can be the Subject of Many Laws.
