fa کاربست الگوهای عملکردی سازمان غذا و داروی آمریکا (FDA) در نظام تنظیم‌گری سازمان غذا و داروی ایران با تأکید بر دستورالعمل‌های غیر رسمی پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><strong>زمینه و هدف:</strong> دولت‌های تنظیمی (مقرراتگذار) برای ایفای نقش خود در‌ تنظیم‌ مناسبات‌ اقتصادی و اجتماعی، بیش از هر چیز به ابزارهایی کارآمد و اثربخش نیاز دارند. دستورالعمل‌های غیر رسمی در زمره این ابزارهاست که سازمان غذا و داروی آمریکا (<span dir="LTR">FDA</span>) برای هدایتگری بازیگران فعال در این صنعت به عنوان روش اصلی سیاستگذاری در مقایسه با دیگر شیوه‌های رسمی به کار می‌گیرد. این روش‌ها می‌توانند در تبیین نظام تنظیمی سایر دولت‌ها به کار گرفته شود.<br> <strong>روش:</strong> این مقاله به روش توصیفی ـ تحلیلی، به صورت کتابخانه‌ای و با ابزار فیش‌برداری کتب و مقالات نگارش یافته است.<br> <strong>یافته‌ها:</strong> در پی پیشرفت‌ها و اصلاحات صورت‌گرفته در نظام مقرراتگذاری <span dir="LTR">FDA</span>، این مقاله به چرایی و چگونگی به کارگیری این سازمان به دستورالعمل‌های غیر رسمی جهت اجرای وظایف قانونی خود در قرن گذشته پرداخته و شاخص‌های ارزشمند آن را به نظام تنظیمی کشورمان معرفی می‌نماید. بدون تردید با کمک‌گرفتن از تجربیات موفق دیگر کشورهای پیشرو در امر تنظیم‌گری، می‌توان امکان توفیق در این حوزه پیچیده را افزایش داد.<span dir="LTR"><span style="font-size:10.0pt;"></span></span><br> <strong>ملاحظات اخلاقی:</strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.<br> <strong><span dir="RTL" style="letter-spacing:-.2pt;">بحث و نتیجه‌گیری:</span></strong><span dir="RTL" style="letter-spacing:-.2pt;"> با عنایت به تحلیل‌های هنجاری ارائه‌شده به نظر می‌رسد توسعه دستورالعمل‌های</span><span dir="RTL"> غیر رسمی به سود ذی‌نفعان اصلی </span>FDA<span dir="RTL"> (نهادهای تنظیم‌شونده، عموم مردم و خود سازمان) است و با توجه به بسترهای حقوقی موجود در نظام تنظیمی سازمان غذا و داروی ایران، این امر قابل بومی‌سازی هنجاری در نظام حقوقی کشورمان می‌باشد. </span></span></span></div> <div style="text-align: justify;"><strong>Background and aim:</strong> Regulatory governments need, above all, efficient and effective tools to play their role in regulating economic and social relations. Informal guidelines are among the tools that the U.S.A Food and Drug Administration (FDA) uses to guide actors in this industry as its primary method of policymaking as opposed on more formalized procedures. These methods can be used to explain the regulatory system of other governments.<strong><span dir="RTL"></span></strong><br> <strong>Method:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles<strong>.</strong><br> <strong>Results:</strong> Following improvements to the FDA regulatory system, this article discusses how and why the FDA&#39;s use of informal guidance to fulfill its statutory mandate has changed over the past century and introduces its valuable indicators to our country&#39;s regulatory system. Undoubtedly, with the help of the successful experiences of other leading countries in the field of regulation, the possibility of success in this complex field can be increased.<br> <strong>Ethical Considerations: </strong>In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<span dir="RTL"></span><br> <strong>Conclusion:</strong> Undertake a normative analysis of the FDA&#39;s increasing reliance on informal guidance, this development has benefited the FDA&#39;s major stakeholders: (regulated entities, the public and the administration itself) and Considering to the existing legal contexts in the regulatory system of the Food and Drug Administration of Iran, this can be a normative localization in the legal system of our country.<br> <br> Please cite this article as: Hoshyaran Jolodar H, Hadavand M.
