fa مسؤولیت‌های ناشی از سوءتکفل کودکان با تأکید بر فقه امامیه و منشور حقوق شهروندی Responsibilities Arising From Child Abuse With Emphasis On Imami Jurisprudence And The Charter Of Citizenship Rights پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در حقوق داخلی ایران و در قانون مدنی این کشور، باب دوم از کتاب هشتم، به مبحث نگهداری و تربیت اطفال اختصاص دارد و در همین زمینه نیز مسؤولیت‌های را بر عهده پدر و مادر قرار داده است که از آن‌ها تحت عنوان: «مسؤولیت‌های ناشی از سوءتکفل» یاد می‌شود. در منشور حقوق شهروندی (مصوب 1395) موضوع نگهداری و تربیت اطفال پیش‌بینی شده است. هدف از این تحقیق همسو شدن افکار جهانی برای حفظ کرامت انسانی و حقوق شهروندی اطفال و جلوگیری از آسیب‌ها و لطماتی است که کودکان را از رسیدن به حقوق واقعی و قانونی آنان باز می‌دارد. مواد و روش‌ها: تحقیق حاضر با روش تطبیقی کاربردی صورت گرفته است برای شناسایی سیاست قانونگذار - در ارتباط با سوءتکفل والدین - موارد قانونگذاری‌شده جهت پیشگیری مسئله سوءتکفل و جبران خسارت وارده بر اطفالی که مورد سوءتکفل قرار گرفته‌اند. ملاحظات اخلاقی: در تمام مراحل نگارش این مقاله اصول اخلاقی و صداقت رعایت گردیده است. یافته‌های تحقیق: یافته‌ها حاکی از این است که اولین موفقیت و رشد و توسعه هر جامعه‌ای بستگی به اطفالی دارد که در آن محیط تربیت و پرورش می‌یابند، درواقع سازندگان واقعی فردای جامعه کودکان هستند. لذا می‌بایست هم نیاز‌های مادی و هم معنوی آنان توسط والدین مورد توجه خاص قرار بگیرد، اما این تربیت نباید با سوءتکفل مواجهه شود و با محدودیت‌هایی شامل: محدودیت‌های ناشی از تزاحم با حقوق جسمانی کودک و محدودیت‌های ناشی از تزاحم با حقوق معنوی کودک روبه‌رو شود. نتیجه‌گیری: بیشتر مشکلاتی که مردم - در ارتباط با فرزندان خود - با آن مواجه هستند، از عدم اطلاع کافی با قوانین و مقررات اسلامی به‌خصوص حقوق شهروندی نشأت می‌گیرد. شناسایی موارد قانونگذاری جرم‌انگاری، مسائل ناشی از مسأله سوءتکفل والدین، شناسایی موارد قانونگذاری‌شده جهت جبران خسارت معنوی بزه‌دیده ناشی از مسأله سوءتکفل، رشد و توسعه علمی کودکان از جمله مواردی است که به دلیل عدم آگاهی به حقوق فردی، اجتماعی و شهروندی کودکان، مسؤولیت‌های ناشی از سوءتکفل را بر والدین آنها می‌گذارد.</div> <div style="text-align: justify;">Background and Aim: In Iranian Domestic Law, in the Iranian Civil law, The Second Chapter of the Eighth Book is Dedicated to the Issue of Child Care and Education and in This Regard, it has Placed Responsibilities on Parents, Which are Referred to as Responsibilities Arising From Negligence. The Charter of Citizenship Rights Approved in 2016 Also Provides for the Maintenance and Upbringing of Children. The Purpose of This Study is to Align Global Views to Protect the Human Dignity and Civil Rights of Children and to Prevent Injuries That Prevent Children From Achieving Their Real and Legal Rights. Materials and Methods: The Present Study is an Applied Comparative Method in Terms of Identifying the Legislator's Policy in Relation to Parental Neglect and Legislated Cases to Prevent the Issue of Negligence, Compensation for Damages to Children Who Have Been Neglected. Ethical Considerations: In All Stages of Writing This Article, Ethical Principles and Honesty Have Been Observed Findings: The Findings Indicate That the First Success, Development and Growth of any Society Depends on the Children in Which They are Brought up, Who are in Fact the Real Builders of the Future of That Society. Therefore, Special Attention Should be Paid to Both Their Material and Spiritual Needs. And in This Regard, they Need to Train Parents. But This Upbringing Should not be Neglected and Faces Limitations, Including Restrictions on Conflict With the Child's Physical Rights and Restrictions on Conflict With the Child's Spiritual Rights. Conclusion: Most of the Problems that People Face in Relation to Their Children Stem From Insufficient Knowledge of Islamic Laws and Regulations, Especially Civil Rights in this Regard. Identifying Legislative Cases of Criminalizing Issues Arising From the Issue of Parental Neglect, Identifying Legislated Cases to Compensate the Moral Damage Suffered by the Issue of Child Neglect, and the Scientific Growth and Development of Children are Among the Cases. Due to the Lack of Awareness of the Individual, Social and Citizenship Rights of Children, the Burden of Negligence Falls on Their Parents.
