fa مصادیق حقوق بیماران در پرتو سلسله مراتب هنجاری حقوق بین‌الملل پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="color:black;">زمینه و هدف:</span></strong> <span style="color:black;">حق بر سلامت به عنوان یکی از مصادیق حقوق بشر پس از تصویب اعلامیه جهانی حقوق بشر و میثاق حقوق اقتصادی، اجتماعی و فرهنگی در قامت یک اصل کلی وارد ادبیات حقوق بین‌الملل موضوعه شد. اصل مزبور در طی سال‌های متمادی از حیث مصادیق گسترش پیدا کرد و از بطن آن مصادیقی پدیدار شدند که ارتباط نزدیکی با وضعیت بیماران دارند.</span><span style="color:black;"><span style="font-size:10.5pt;"></span></span><br> <strong><span style="color:black;">مواد و روش‌ها:</span></strong> <span style="color:black;">این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm;باشد و روش جمع‌آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><strong><span style="color:black;"><span style="font-size:10.5pt;"></span></span></strong><br> <strong><span style="color:black;">یافته‌ها: </span></strong><span style="color:black;">وضعیت بیماران و فرآیند درمان آن‌ها یکی از موضوعات مهم در حوزه حق بر سلامت به عنوان یکی از مصادیق حقوق بشر بین‌المللی محسوب می‌شود. از طرفی نیز مجموعه هنجارهای حقوق بشر دارای ارتباطی نزدیک و به هم‌پیوسته هستند؛ به تعبیری، نقض هریک از هنجارهای مزبور منتهی به نقض غیر مستقیم سایر هنجارها نیز می‌شود.</span><span style="color:black;"><span style="font-size:10.5pt;"></span></span><br> <strong><span style="color:black;">ملاحظات اخلاقی:</span></strong> <span style="color:black;">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><span style="color:black;"><span style="font-size:10.5pt;"></span></span><br> <strong><span dir="RTL"><span style="color:black;">نتیجه‌گیری:</span></span></strong> <span dir="RTL"><span style="color:black;">برای تعیین جایگاه مصادیق حقوق بیماران باید دو معیار خاص را در نظر بگیریم: اول ارتباط حقوق مزبور با قواعد آمره حقوق بین‌الملل و دوم معیار &laquo;وابستگی یا عدم وابستگی به منابع&raquo;. در میان مصادیق مختلف حقوق بیماران، برخی از مصادیق مزبور درواقع به نحوی به عنوان مصداقی از قواعد آمره حقوق بین‌الملل محسوب می‌شوند. سایر مصادیق حقوق بیماران به عنوان مصداقی از قواعد آمره محسوب نمی‌‌شوند، اما نباید از نظر دور داشت که مصادیق مزبور وابستگی بسیار ناچیزی با وجودِ منابع مالی برای تأمین و تضمین آن‌ها دارند. به نظر می‌رسد که این دسته از حقوق بیماران نیز ظرفیت تبدیل شدن به مصداقی از قواعد آمره جدید در فضای حقوق بشر بین‌المللی و به طور خاص حقوق بیماران را دارند.</span></span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The Right to Health as an Example of Human Rights Entered the International Law Literature as a General Principle After the Adoption of the Universal Declaration of Human Rights and the Covenant on Economic, Social and Cultural Rights. This Principle has Developed Over the Years in Terms of Instances, and From Within it Have Emerged Instances That are Closely Related to the Condition of Patients.<br> <strong>Materials and Methods:</strong> This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles.<br> <strong>Findings:</strong> The Status of Patients and Their Treatment Process is one of the Most Important Issues in the Field of Health Rights as one of the Examples of International Human Rights. On the Other Hand, the Set of Human Rights Norms is Closely and Interconnected; In Other Words, Violation of any of These Norms Leads to Indirect Violation of Other Norms.<br> <strong>Ethical Considerations:</strong> In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.<br> <strong>Conclusion:</strong> To Determine the Status of Instances of Patients&#39; Rights, We Must Consider Two Specific Criteria: The First is the Relationship Between These Rights and the Rules of International Law and the Second is the Criterion of &quot;Dependence or Non-Dependence on Resources&quot;. Among the Various Instances of Patients&#39; Rights, Some of These Instances are in Fact Regarded as Examples of the Peremptory Norms of International Law. Other Examples of Patients&#39; Rights are not Considered as a Peremptory Norm, But it Should not be Overlooked That These Cases Have Very Little Dependence on the Financial Resources to Provide and Guarantee Them. It Seems That This Category of Patients &#39;Rights Also Has the Capacity to Become an Example of the Peremptory Norms in the International Human Rights Environment, and in Particular Patients&#39; Rights.<br> <br> <strong>Cite this article as: </strong>Ziafati Sabbagh Z.
