fa اختراعات موجودات اصلاح‌شده ژنتیکی (تراریخته) در حقوق تطبیقی (بررسی رویکرد نظام‌های حقوقی آمریکا، کانادا، اتحادیه اروپا و ایران و موافقت‌نامه تریپس) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف:</span></b> <span lang="AR-SA">موجودات<b> </b>اصلاح‌شده ژنتیکی (تراریخته)، آفریده‌های فکر خلاق بشری هستند و حق اختراع به عنوان یکی از قالب‌های مالکیت فکری، موجد نوعی حق انحصاری برای این نوع از محصولات می‌باشد. حمایت از اختراعات در حوزه محصولات تراریخته، به شرکت‌ها یک نوع حق کنترل و نظارت بر اختراع را فراهم می‌کند.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b> <span lang="AR-SA">روش تحقیق این مقاله به صورت توصیفی ـ تحلیلی می‌باشد و روش گردآوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">ملاحظات اخلاقی:</span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر اصالت متن، صداقت و امانتداری رعایت شده است.</span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b> <span lang="AR-SA">به علت حاکمیت اصل سرزمینی‌بودن بر قوانین مالکیت فکری، نظام حقوقی کشورها در مورد ثبت اختراع متنوع است. تولیدکنندگان عمده محصولات تراریخته از کشورهای صنعتی پیشرفته، مانند آمریکا، کانادا و کشورهای اروپایی می‌باشد و در عین حال ثبت اختراعات این حوزه علیرغم برخی جنبه‌های حقوقی با استقبال <span style="letter-spacing:-.1pt">فراوانی مواجه شده است. در حال حاضر در ایران نیز شاهد توسعه این نوع</span> از محصولات هستیم.</span><b><span style="font-family:"B Nazanin"" lang="FA"></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">شناسایی محصولات تراریخته اغلب با حمایت در قالب حق اختراع پیوند خورده، به گونه‌ای که این بحث به یکی از جنجالی‌ترین بحث‌های حول زیست‌فناوری و شاخه‌های آن تبدیل شده است. حق اختراع یک حق قانونی و انحصاری برای بهره‌برداری مالی مخترع فراهم می‌کند. آمریکا و اروپا با توجه به رویکرد منعطف موافقت‌نامه تریپس ثبت اختراع را تجویز نموده‌‌ و هر دو در زمینه ثبت اختراع این حوزه پیشگام بوده‌اند. در مقابل کانادا رویکرد متفاوتی در پیش گرفته و از ثبت اختراعات حیوانات و گیاهان اصلاح‌شده ژنتیکی امتناع ورزیده است. حال در ایران شرکت‌ها و مؤسسات تحقیقاتی وقت و هزینه فراوانی را در خصوص ابداعات این حوزه صرف می‌کنند بدون اینکه از نظام حمایتی خاصی برای ابداعات و اختراعات خود بهره‌مند باشند.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b>Background and Aim:</b> Genetically modified (transgenic) organisms are the creatures of human creative thought, and patents, as a form of intellectual property, give rise to a kind of patent for this type of product. Protecting patents in the field of transgenic products gives companies a kind of patent control.</span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b>Method:</b> <span style="background:#f2f2f2">This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles.</span><span style="font-family:"Times New Roman","serif"" lang="EN"></span></span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b><span lang="EN">Ethical Considerations<span style="background:#f2f2f2">:</span></span></b> <span style="background:#f2f2f2">In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.</span><span style="font-family:"Times New Roman","serif""></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b>Results<span style="background:#f2f2f2">:</span></b><b> </b><span style="background:#f2f2f2">Because of principle of territorial and the laws of intellectual property, the patent legal system is different. The major producers of transgenic products are from advanced industrialized countries such as the United States, Canada, and European countries, and at the same time, patents in this field have been widely welcomed despite some legal aspecys. We are currently developing this type of products in Iran.</span><span style="font-family:"Times New Roman","serif""></span></span></span><br> <b><span style="font-size:11.0pt"><span style="line-height:107%">Conclusion<span style="background:#f2f2f2">:</span></span></span> </b><span style="font-size:11.0pt"><span style="background:#f2f2f2"><span style="line-height:107%">The identification of transgenic products is often connected to patent protection, which has become one of the most controversial issues in biotechnology and its fields. A patent provides a legal and exclusive right for the financial exploitation of the inventor. The United States and Europe have prescribed patents under the TRIPS Agreement due to their flexible approach, and both have been pioneers in the field of patents. In contrast, Canada has taken a different approach and refusing to patent genetically modified animals and plants.
