fa حق بر سلامت سالمندان در پرتو نظام حقوق بشر بین‌المللی پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف</span></strong>: حق بر سلامت سالمندان در حال حاضر به عنوان یکی از موضوعات مهم و پیچیده در سطح بین‌المللی مطرح است. در پژوهش حاضر حق بر سلامت سالمندان در پرتو هنجارهای بین‌المللی مورد بحث و بررسی قرار خواهد گرفت و روندها و چشم‌اندازهای اجرای مؤثر این حق مورد شناسایی قرار می‌گیرد.<em><span style="font-size:10.5pt;"></span></em><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات بصورت کتابخانه &rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><strong><span style="letter-spacing:-.1pt;"><span style="font-size:10.5pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>سه رویکرد متفاوت در ارتباط با حقوق افراد سالمند اتخاذ شده است. در میان این رویکردها، به نظر می‌رسد که رویکرد دولت‌های اروپایی واقع‌بینانه و عملی می‌باشد. در اروپا با توسل به اسناد و راهکارهای غیرالزام‌آور سعی در ایجاد همگامی و وحدت رویه‌ در فضای روابط تابعان و بازیگران وجود دارد. به همین دلیل است که تعهدات غیرالزام‌آور به صورت &laquo;دقیق&raquo; و &laquo;جزیی&raquo; برای دولت‌ها تعریف شده است.<span dir="LTR"><span style="font-size:10.5pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت‌داری رعایت شده است.<span style="letter-spacing:-.1pt;"><span style="font-size:10.5pt;"></span></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">به نظر می‌رسد برای وضعیت حق بر سلامت سالمندان باید به تفسیر هنجارهای موجود پرداخت. همچنین باید دائماً بر این نکته تأکید داشته باشیم که تبعیض بر اساس معیار سن در دسترسی به مراقبت‌های بهداشتی، توانبخشی، درمان‌های مدرن، داروسازی و اطلاعات مربوط به حوزه بهداشت، شرایط نامناسب زندگی، در چهارچوب حقوق بشر بین‌المللی، حق سالمندان در تمتع از بالاترین سطح سلامت جسمی و روانی را نقض می‌کند.</span></span></span><span dir="LTR"></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The right to health for the elderly is currently one of the most important and complex issues at the international level. In the present study, the right to health of the elderly will be discussed in the light of international norms and the trends and perspectives of effective implementation of this right will be identified.<br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<br> <strong>Results:</strong> Three different approaches have been adopted in relation to the rights of the elderly. Among these approaches, the approach of European governments seems to be realistic and practical. In Europe, by resorting to non-binding documents and solutions, there is an attempt to create synchronicity and unity of procedure in the space of relations between subjects and actors. That is why non-binding obligations are defined as &quot;precise&quot; and &quot;partial&quot; for governments.<br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion</strong>: It seems that the existing norms should be interpreted for the status of the right to health of the elderly. We must also constantly emphasize that age-based discrimination in access to health care, rehabilitation, modern therapies, pharmacy and health information, poor living conditions, within the framework of international human rights, it violates the right of the elderly to enjoy the highest levels of physical and mental health.<br> <br> <strong>Cite this article as:&nbsp;</strong>Toutounchian M, Jafari A,&nbsp; Moazen F, Beyranvand F.
