fa مقایسه نظام نیمه ریاستی و ریاستی در ایران و آمریکا با تأکید بر اصل تفکیک قوا Comparison of the semi-presidential and presidential system in Iran and the United States with emphasis on the principle of separation of powers پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: تمام نظامهای سیاسی و حقوقی تابعی از یک ساختار سیاسی واحد می باشند. در کشور ایران ساختار نظام به شکل نیمه ریاستی – نیمه پارلمانی می باشد و در کشور آمریکا نیز به شکل ریاستی اداره می شود. هدف این تحقیق پاسخ به این سوال اساسی است که آیا وحدت مقام رهبری و مقام اجرایی بهتر است یا تعدد آن؟ یعنی در آمریکا وحدت این دو (رهبری، اجرایی) شکل گرفته، این یگانگی (قوه مجریه انفرادی) بهتر است یا دوگانگی (دو ارگانی قوه اجرائیه) که در ایران حاکم است. مواد و روش‌ها: این مقاله توصیفی - تحلیلی، و با بهره گیری از روش اسنادی و استفاده از ابزار فیش برداری تهیه و تدوین گردیده است. یافته‌ها: یافته ها حاکی از این است که؛ نظام حاکم در ایران نظام حاکم نیمهریاستی نیمه پارلمانی میباشد نظام نیمه‌ریاستی نوعی نظام حکومتی است که ویژگی‌های نظام ریاستی و نظام پارلمانی در آن تلفیق شده‌اند. و در نظام حقوقی آمریکا (قانون اساسی) آمریکا کشوری است فدرالی که یک حکومت ملی و حکومت های محلی پنجاه گانه دارد قوه مجریه فدرالی که از نوع ریاستی است. ملاحظات اخلاقی: از ابتدا تا انتهای مقاله با پایبندی به اصول صداقت و امانتداری تهیه و تدوین گردیده است. نتیجه‌گیری: در این مدل نیمه ریاستی- نیمه پارلمانی که در ایران حاکم است، مثل نظام‌های ریاستی ریاست کشور بر عهده رئیس‌جمهوری است که در انتخابات عمومی به قدرت رسیده و مظهر حاکمیت ملی محسوب می‌شود و از مسئولیت سیاسی در برابر پارلمان مبراست، اما بر خلاف نظام‌های ریاستی و به شیوه نظام‌های پارلمانی هیئت وزیران با دریافت رأی اعتماد از نمایندگان مجلس رسمیت پیدا می‌کند و در جریان فعالیت‌های خود در برابر پارلمان مسئولیت سیاسی دارند و پارلمان قادر است با رأی عدم اعتماد هیئت دولت را از قدرت ساقط کند. در مدل ریاستی که نمونه آن در ساختار سیاسی آمریکا حاکم است، در مدل ریاستی معمولاً تک نهادی است و همه اقتدارات اجرایی و عوامل قوه مجریه در اختیار رئیس جمهور است، رئیس جمهور بالاترین مقام رسمی کشور است و از اختیارات تام برخوردار است.</div> <div style="text-align: justify;">Background and Aim: All political and legal systems are a function of a single political structure. In Iran, the system structure is in the form of a semi - presidential - parliamentary form and is run in Presidential. the purpose of this study is to answer the question whether the unity of leadership status and executive authority is better or the multiplicity of it? that is, in the united states, the unity of the two (leadership, executive) has been formed, it is best (individual executive power) or duality (two branches of executive power) in iran. Materials and Methods: This paper is descriptive analytical, and it has been developed using documentary method and taking note of note tools. Results: The findings indicate that the ruling system in Iran is a semi - parliamentary system, a system of governance that is integrated with the administrative system and the parliamentary system. And in the US legal system (the constitution) of the United States, a federal government, which has a national government and a double government, is the federal executive of the Presidential Administration. Ethical considerations: From the beginning to the end of the article, it is formulated and formulated by adherence to the principles of honesty. Conclusion: In this semi - presidential - presidential model that is ruling in Iran, such as Presidential Presidential systems, it is responsible for the Presidency of the Republic, which represents a national sovereignty and enjoys political responsibility to the parliament, and parliament is capable of overthrowing the government with a vote of confidence. in the presidential model, which is a model in the political structure of the united states, the Presidential model is usually the single entity and all executive powers and executive powers are available to the president, the president is the country's highest official and enjoys his authority.
