fa سیاست جنایی ایران در خصوص پیشگیری از جرم تغییر کاربری غیرمجاز اراضی زراعی و باغی پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> حفاظت از اراضی زراعی و باغی، نقش مهمی در حفظ محیط زیست و استمرار حیات بشری دارد و حمایت از آن‌ها به منزله حمایت از محیط زیست و حیات بشر است. تغییر کاربری اراضی زراعی و باغی نتیجه نقص قوانین موجود و عدم اجرای صحیح همین قوانین ناقص توسط مجریان آن و بی‌توجهی به اهمیت آن و فرصت طلبی عده‌ای از سودجویان است.<strong><span style="letter-spacing:-.1pt;"><span style="font-family:B Nazanin;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong><span style="letter-spacing:-.1pt;"> این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع&rlm; آوری اطلاعات بصورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>اتخاذ راهکارهای کیفری برای مقابله با این پدیده، از جمله اقداماتی است که قانون&shy;گذاران بدان متوسل شده‌اند. قانون‌گذار در چندین مرحله، تغییر کاربری اراضی زراعی را مهم دانسته و آن را جرم &shy;انگاری نموده است؛ مانند قانون گسترش قطب‌های کشاورزی مصوب سال ۱۳۵۴ و قانون حفظ کاربری اراضی زراعی و باغ‌ها مصوب ۱۳۷۴. آخرین قانون وضع شده در این خصوص قانون اصلاح قانون حفظ کاربری اراضی زراعی و باغ‌ها مصوب ۱۳۸۵ و آیین&shy; نامه‌ی آن بوده که در ماده ۳ آن، کیفر قلع و قمع بنا و جزای نقدی را برای مرتکبین این جرم در نظر گرفته است که در صورت تکرار مجازات حبس نیز خواهد داشت.<span dir="LTR"></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<span style="letter-spacing:-.1pt;"><span style="color:black;"></span></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">به نظر می‌رسد لازم است مقنن با ابهام</span>‌<span dir="RTL">زدایی از این قانون و تعیین راهکارهای کاربـردی</span><span dir="RTL">&shy;</span><span dir="RTL">تر و استفاده از روش</span>‌<span dir="RTL">های پیشگیری و فرهنگ</span>‌<span dir="RTL">سازی، قدم</span>‌<span dir="RTL">های بلندتری را برای مقابله با این پدیده بردارد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The protection of agricultural and horticultural lands has an important role in preserving the environment and the continuation of human life, and their protection constitutes the protection of the environment and human life. The change of use of agricultural and horticultural lands is the result of the shortcomings of the existing laws and the inadequate implementation of these flawed laws by its implementers and the disregard for its importance and the opportunism of some profiteers.<span dir="RTL"></span><br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<span dir="RTL"></span><br> <strong>Results:</strong> Adopting criminal measures to combat this phenomenon is one of the measures that legislators have resorted to. During the stage, the law considered the change of use of agricultural lands important and criminalized it; Such as the Law on the Development of Agricultural Centers approved in 1975 and the Law on Conservation of Agricultural Lands and Gardens approved in 1995. The last law enacted in this regard was the Law on Amending the Law on Preservation of the Use of Agricultural Lands and Gardens, approved in 2006, and its by-laws, which in Article 3 provide for the punishment of demolition and fines for perpetrators of this crime. There will also be imprisonment.<span dir="RTL"></span><br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<span dir="RTL"></span><br> <strong>Conclusion</strong>: It seems necessary for the legislator to take greater steps to deal with this phenomenon by removing the ambiguity of this law and determining more practical solutions and using prevention and culture-building methods.<span dir="RTL"></span><br> <br> <strong>Cite this article as: </strong>Mostafanejhad Mousavi SR, Salimi S, Rohani K.
