fa مجازات‌های جایگزین حبس در تحقق اهداف حاکم بر مجازات‌ها Alternative Punishments to Imprisonment in Achieving the Goals of Punishments پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: کیفر یا همان مجازات، یکی از متداول‌ترین ابزارها و نمودهای واکنش اجتماعی در قبال ارتکاب فعل مجرمانه بزهکار هستند. در حقوق جزای، مجازات‌ها توسط قانون گذاران جهت تأمین اهداف نظام عدالت کیفری انتخاب می‌شوند. در پژوهش حاضر هدف اصلی این است که مجازات های جایگزین حبس تا چه اندازه می توانند اهدافی که در طراحی مجازات ها دنبال می شوند را تحقق بخشند. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی - تحلیلی می &rlm;باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه &rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: سیاست جنایی سازمان ملل متحد و نظام‌های حقوقی پیشرفته معاصر، با الهام از دیدگاه‌های نوین جرمشناسی و کیفرشناسی و جامعه شناسی کیفری بر این اساس استوار می‌باشد که استفاده از زندان با چالش‌هایی روبروست، که یکی از این چالش‌ها، عدم تحقق اهداف حاکم بر مجازات ها در کیفر حبس می‌باشد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: کیفر حبس دارای برخی ویژگی ها و اهدافی می باشد که مانع از ارتکاب جرم شده و در مقابل نیز از پیامدهایی برخوردار است که تأثیر منفی بر مجرم و جامعه می گذارد. با توجه به معایب کیفر حبس، بحث از مجازات‌های جایگزین مطرح می‌شود. حقوقدانان برای جایگزین های حبس به شرط اجرای صحیح، دقیق و اصولی، ویژگی هایی مثبتی قائل شدند که می تواند موجب کاهش جرم در جامعه شود؛ از جمله برآورده ساختن اهداف مجازات نظیر: اصلاح مجرم، بهاین معنی که با جامعه سازگار شده و به عنوان شهروندی متعهد در جامعه فعالیت کند. بازدارندگی، هم برای مجرم و هم برای افراد جامعه، مساعدت و سرپرستی وی، تقویت حس مسئولیت پذیری، افزایش تعهد مجرم به جامعه، افزایش حضور وی در جامعه، مشارکت جامعه مدنی در اجرای مجازات و ویژگی هایی که پیامدهای منفی حبس را دارا نمی باشد.</div> <div style="text-align: justify;">Background and Aim: Punishment is one of the most common tools and manifestations of social reaction to the commission of a criminal act. In criminal law, punishments are chosen by legislators to achieve the goals of the criminal justice system. In the present study, the main goal is to what extent alternatives to imprisonment can achieve the goals pursued in the design of punishments. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Results: Inspired by new perspectives on criminology and criminal science and criminal sociology, the United Nations criminal policy and advanced contemporary legal systems are based on the premise that prison use faces challenges, one of these challenges is the failure to achieve the goals of punishment in imprisonment. Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The punishment of imprisonment has some characteristics and purposes that prevent the commission of a crime and in return has consequences that have a negative impact on the offender and society. Given the disadvantages of imprisonment, alternative punishments are discussed. Lawyers attributed positive features to alternatives to imprisonment, provided they were implemented correctly, accurately, and in principle, which could reduce crime in society; Including meeting punishment goals such as: Correction of the offender, means to adapt to society and to act as a committed citizen in society. Deterrence, both for the offender and for members of society, his assistance and supervision, strengthening the sense of responsibility, increasing the offender's commitment to society, increasing his presence in society, civil society participation in the execution of punishment and characteristics that do not have negative consequences of imprisonment.
