fa مسؤلیت مدنی شهرداری ناشی از عدم انجام وظایف و تکالیف قانونی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> شهرداری به عنوان یک شخص حقوقی عمومی غیردولتی در راستای ایفای وظایف و تکالیف قانونی و خدمات&shy;رسانی به شهروندان ممکن است باعث بروز خسارت&shy; هایی گردد که احکام و قواعد ایجاد مسولیت مدنی آن با دیگر اشخاص حقیقی یا حقوقی مشترک بوده، اما آنچه موضوع بررسی مقاله حاضر را تشکیل می&shy;دهد بررسی مبانی حقوقی مسؤل دانستن شهرداری ناشی از عدم انجام وظایف و تکالیفی (ترک فعل) است که قانون بر عهده شهرداری گذاشته و بررسی میزان مسولیت آن و چگونگی جبران خسارت به عنوان یک نهاد عمومی غیردولتی است.<strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.0pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong><span style="letter-spacing:-.1pt;"> این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>هر چند که در ماده یازده قانون مسولیت مدنی شقوق و شرایطی که برای تحقق مسئولیت کارمندان شهرداری و مؤسسات وابسته به آنها مشخص و حدود ضمان آنها تا حدودی معلوم شده، اما دغدغه اصلی مشخص نمودن چگونگی و میزان مسئولیت شهرداری ناشی از ترک وظایف و تکالیفی است که موجب ورود خسارت به اشخاص به صورت عمد یا سهو می&shy; شود.<span dir="LTR"><span style="font-size:11.0pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">در خصوص خسارات ناشی از اعمال حاکمیت هم در صورتی که دو شرط موجود باشد اشخاص حقوق عمومی از جبران زیان و پرداخت خسارت معاف خواهند بود. اول اینکه اشخاص حقوق عمومی در مقام اعمال حاکمیت باشد و دوم آن که، آن عمل حسب ضرورت و طبق قانون برای تأمین منافع اجتماعی به عمل آید.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The municipality, as a public non-governmental legal entity, in order to perform its legal duties and services and provide services to citizens, may cause damages that the rules and rules of establishing civil liability are shared with other natural or legal persons. But what is the subject of this article is the study of the legal basis for holding the municipality responsible for failure to perform duties and tasks (omission) that the law imposes on the municipality and the extent of its responsibility and how to compensate as a public non-governmental organization.<br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<br> <strong>Results:</strong> Although Article 11 of the Civil Liability Law stipulates the conditions for fulfilling the responsibilities of municipal employees and their affiliated institutions and the extent of their guarantees, the main concern is to determine how and to what extent municipal responsibilities arise from leaving duties and responsibilities. Which causes damage to persons intentionally or accidentally.<br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion</strong>: Regarding damages resulting from the exercise of sovereignty, if there are two conditions, public law entities will be exempt from compensation and payment of damages.
