fa حمایت از نرم افزارهای بیوانفورماتیک در قالب نظام حقوق مالکیت فکری: مطالعه تطبیقی Intellectual Property Protection in Bioinformatics Software: Comparative Study پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: نوآوری های بیوانفورماتیک عموما به منظور جمع آوری، ذخیره، پردازش یا تجزیه و تحلیل داده های زیستی به روش های پیاده سازی شده توسط رایانه حاصل می شوند. بـر این اساس می توان ادعا کرد نرم افزارها شالوده اصلی و بنیادین بیوانفورماتیک بوده و حمایت از نرم افزارهای بیوانفورماتیک نیز یکی از عوامل کلیدی رشد و توسعه این علم می باشد. با توجه به ویژگی های خاصی که توسعه و بکارگیری نرم افزارهای بیوانفورماتیک دارند، بررسی قوانین و نوع نظام های حمایتی که قابل اعمال بر این نرم افزارها نیز باشند موضوعی درخور توجه است. مواد و روش‌ها: ایـن تـحقیق از نـوع نظری و بـه روش تـحلیلی - تطبیقی می‌باشـد. جمع آوری و فیشبرداری اطلاعات نیز با استفاده از روش کتابخانه‌ای و مراجعه به اسناد، کتب و مقالات صورت پذیرفته است. یافته‌ها: یافته‌ها حاکی از این است بجز چند کشور پیشرفته صنعتی، رویه قضایی خاصی در مورد دعاوی پیچیده مربوط به نرم افزارهای بیوانفورماتیک وجود ندارد. قوانین ذیربط قابل اعمال در کشورهای منتخب نیز عمدتاً محدود به نظام های سنتی حقوق مالکیت فکری است و هیچ قانون سوئی ژنریس (خاص) متوجه حمایت از نرم افزارهای بیوانفورماتیک نمی باشد. ملاحظات اخلاقی: در تمامی مراحل نگارش مقاله حاضر، اصول اخلاقی پژوهش، به ویژه اصالت متن، صداقت، رازداری و امانت‌داری رعایت شده است. نتیجه‌گیری: با توجه به رویه و منافع متفاوت کشورهای منتخب مورد بررسی، شاهد شباهت ها و تناقضات زیادی در آن حوزه های قضایی پیرامون حمایت از نرم افزارهای بیوانفورماتیک می باشیم. بر این اساس، در سطح بین المللی نیاز به هماهنگ سازی مقررات مربوطه کاملاً احساس می شود. با این اوصاف به نظر می رسد با توجه به تجربیات جهانی، صرفنظر از وجـود نظام حمایتی خاص و یا انطباق پذیری نرم افزارهای بیوانفورماتیک با نظام های سنتی مالکیت فکری، شایسته است الزامات فنی، تجاری و حقوقی مورد نیاز جهت حمایت از این نرم افزارها با دقت و جزئیات بیشتری مورد بازبینی قرار گرفته تا ابهامات و خلاءهای قانونی متوجه نرم افزارهای بیوانفورماتیک شناسایی و برطرف شده و به تبع آن، بستر حقوقی مقتضی و جامعی در این عرصه فراهم شود.</div> <div style="text-align: justify;">Background and Aim: Bioinformatics innovations are generally designed to collect, store, process, or analyze biological data using computer-implemented methods. Therefore, it is considered that software is the main foundation of bioinformatics and protecting bioinformatics software is a key element for growth and development of this science. Given the special features of the development and application of bioinformatics software, the study of regulations and different types of legal protection systems that can be applied to these softwares is a matter of concern.   Materials and Methods: The research method is analytical-comparative. It has been prepared and compiled by library method using data collection and note-taking techniques in documents, books and articles.   Results: The findings indicate that, except in a few industrialized countries, there is no specific case law in the field of bioinformatics software. Applicable laws and regulations in the selected countries are also largely restricted to traditional intellectual property laws, and no sui-generis legistation has been adopted to protect bioinformatics software.   Ethical considerations: In all stages of writing this paper, the ethical principles of research, especially, the originality of the text, honesty and confidentiality have been fully observed.   Conclusion: Due to different approaches and interests of the selected countries, <a name="OLE_LINK8"></a><a name="OLE_LINK7">we see many similarities and contradictions regarding</a> the protection of bioinformatics software. Accordingly, <a name="OLE_LINK16">the need to harmonize </a>relevant regulations at international level <a name="OLE_LINK12"></a><a name="OLE_LINK11">is fully felt</a>. However, based on global experiences, it seems that <a name="OLE_LINK13">regardless of whether bioinformatics software conformed with traditional IP laws or a sui-generis law </a>is required, <a name="OLE_LINK15"></a><a name="OLE_LINK14">it is necessary to </a>review more carefully and in more detail <a name="OLE_LINK18"></a><a name="OLE_LINK17">legal, commercial and technical r</a>equirements <a name="OLE_LINK19">and resolve </a><a name="OLE_LINK21"></a><a name="OLE_LINK20">any ambiguities or gaps within legal protection that bioinformatics softaware face</a>, in order to provide an appropriate and comprehensive legal framework in this field.
