fa رمزارزها در پرتو فقه و حقوق بین الملل Cryptocurrencies in the light of Figh and international law پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: یکی از جنبه های مهم از زندگی انسان که تحت تأثیر پیشرفت های علم و تکنولوژی قرار گرفته است، فضای تجارت الکترونیکی می &rlm;باشد. در فضای مزبور یکی از متغیرهای مهم، «فرآیند پرداخت» و یکی از ابزارهای مهم آن یعنی رمزارزها می باشد. هدف از پژوهش حاضـر تحلیل و بررسی ماهیـت رمزارزها از منظر فقـه نظام حقـوق بین الملل می باشد. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: یافته های پژوهش نشان می دهد که در فضای فقه، با در نظر گرفتن اصول و قواعد فقهی، منع صریحی در ارتباط با جواز تلقیِ رمزارزها به عنوان مصداقی از مفهوم مال وجود ندارد و معاملات آنها صحیح به نظر می رسد. از طرفی در فضای حقوق بین الملل، دولتها و به طور خاص قـدرت های اول اقتصادی (مانند گروه جی20) به دلایل مختلف کـه در گزارش های متعدد سازمان های بین المللی اقتصادی مانند صندوق بین المللی پول، سازمان تجارت جهانی و... منعکس شده است، با دیدهی تردید به رمزارزها نگریسته می شود. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: نتایج پژوهش نشان می دهد که از منظر فقه حکومتی، استفاده از رمزارزها دارای چالش های فراوانی می باشد زیرا رمزارزها فاقد پشتوانه ی ملی هستند. از طرفی، همین مسئله باعث شده است که در فضای حقوق بین الملل نیز، سازمان های تجاری-مالی تمایلی به شناسایی صریح رمزارزها به عنوان پول در قالب اسناد لازمالاجرا نداشته باشند.</div> <div style="text-align: justify;">Background and Aim: One of the most important aspects of human life that has been influenced by advances in science and technology is the e-commerce space. In this space, one of the important variables is the "payment process" and one of its important tools is the cryptocurrencies. The purpose of this study is to analyze the nature of cryptocurrencies from the perspective of the jurisprudence of the international legal system. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Results: Findings show that in the field of jurisprudence, considering the principles and rules of jurisprudence, there is no explicit prohibition regarding the permission to consider cryptocurrencies as an example of the concept of property and their transactions seem correct. On the other hand, in the field of international law, governments, and in particular the first economic powers, for various reasons, which have been reflected in numerous reports of international economic organizations such as the International Monetary Fund, the World Trade Organization, etc. The cryptocurrencies are viewed with skepticism. Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The results show that from the perspective of government jurisprudence, the use of cryptocurrencies has many challenges because cryptocurrencies lack national support. On the other hand, this issue has caused that in the field of international law, commercial-financial organizations are not willing to explicitly identify cryptocurrencies as money in the form of binding documents.
