fa بررسی تطبیقی ضمانت اجرای دادرسی منصفانه در نظام حقوقی ایران و اتحادیه اروپا Comparative study of the guarantee of fair trial in the legal system of Iran and the European Union پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حق برخورداری از دادرسی منصفانه دربرگیرنده مجموعه ای از اصول و قواعد است که جهت رعایت حقوق طرفین در رسیدگی به دعوای آنان پیش بینی گردیده است. این تضمینات که در اسناد بین المللی حقوق بشر، نظیر اعلامیه جهانی حقوق بشر، میثاق مربوط به حقوق مدنی و سیاسی، کنوانسیون اروپایی حقوق بشر، کنوانسیون آمریکایی حقوق بشر، به عنوان یکی از حقوق بنیادین و اساسی شناخته شده بشر مورد اشاره قرار گرفته است. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی - تحلیلی می &rlm;باشد و روش جمع&rlm; آوری اطلاعات بصورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: یافته های پژوهش نشان میدهند که اصول بین المللی دادرسی منصفانه اگر با دقت و شهامت اجرا شود، به تقویت اعتماد عمومی به دادرسی منصفانه و معتمدانه منجر می شود چرا که سلامت و صحت عمل سایر قوای کشوری در گرو سلامت دستگاه قضایی است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: اصول دادرسی منصفانه در رسیدگی های مدنی در حقوق اتحادیه اروپا و حقوق ایران مشترک است. اما در هر دو حقوق ایران و دادگاههای اتحادیه اروپا، اصول دادرسی منصفانه به صراحت دارای ضمانت اجرا نبوده و ضمانت اجراهایی که مطرح می شوند به دلیل پذیرفته شدن روح اصول دادرسی منصفانه که در قوانین ایران و اتحادیه اروپایی به آن اشاره شده است می باشد و نه اینکه ضمانت اجرا صراحتاً برای دادرسی منصفانه در نظر گرفته شده باشد.</div> <div style="text-align: justify;">Background and Aim: The right to a fair trial includes a set of principles and rules designed to protect the rights of the parties to their litigation. These safeguards are enshrined in international human rights instruments, such as the Universal Declaration of Human Rights, the Covenant on Civil and Political Rights, the European Convention on Human Rights, and the American Convention on Human Rights, as one of the fundamental human rights recognized. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Results: Findings show that the international principles of fair trial, if implemented with care and courage, will strengthen public confidence in a fair and credible trial because the health and correctness of the actions of other powers depends on the health of the judiciary. Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The principles of fair trial in civil proceedings are common to EU law and Iranian law. But in both Iranian law and the courts of the European Union, the principles of fair trial are not explicitly guaranteed, and the guarantee of enforcement is due to the acceptance of the spirit of the principle of fair trial as enshrined in Iranian and European Union law, nor is the enforcement guarantee explicitly intended for a fair trial.
