fa آسیب‌شناسی حمایت حقوقی مطلوب از بزه‌دیدگان ناتوان ذهنی در نظام کیفری ایران (با رویکردی به اسناد بین‌المللی و حقوق امریکا) پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف:</span></b> <span lang="AR-SA">بزه‌دیدگان ناتوان ذهنی به جهت محدودیت‌های ناشی از نقایص ذهنی و روانی مبتلابه، شامل گروه‌های آسیب‌پذیر جامعه تلقی گردیده و توجه خاص مقنن کیفری، در جهت قراردادن ایشان، تحت لوای حمایت قوانین شکلی و ماهوی امری انکارناپذیر است و همین امر در اسناد بین‌المللی به عنوان یکی از ملاک‌های آسیب‌شناسانه برای حمایت از این گروه می‌باشد. هدف از مقاله پیش رو تبیین آسیب‌شناسانه حمایت حقوقی مطلوب از بزه‌دیدگان ناتوان ذهنی در نظام کیفری ایران با نگاهی به اسناد بین‌المللی و حقوق امریکا می‌باشد.</span><span dir="LTR"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b> <span lang="AR-SA">این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">ملاحظات اخلاقی:</span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b> <span lang="AR-SA">قانونگذار ایران و مشخصاً مقنن کیفری به جز در موارد معدود و پراکنده جرم‌انگاری و تشدید مجازات، در مواد قانونی به صراحت توجه ویژه و رویه ضابطه‌مند به ناتوانان ذهنی به عنوان بزه‌دیدگان خاص و نیازمند حمایت پدیدار نساخته، لکن در قوانین ماهوی و شکلی، سیاست‌های حمایتی خود را به صورت ضمنی در قبال این گروه آسیب‌پذیر اتخاذ نموده است.</span><span style="font-family:"B Nazanin"" lang="FA"></span></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">با مداقه نظر در قوانین آمریکا می‌توان یافت که مقنن این کشور با گستره چتر حمایتی، از رهگذر مقررنمودن قوانین و مقررات ویژه، با تعیین نهادها و سازمان‌های حامی توانسته، حقوق بزه‌دیدگان ناتوان را تا حدودی گسترش دهد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:14px;"><span style="line-height:115%"><b>Background and Aim:</b> Mentally handicapped victims are considered vulnerable groups in society due to the limitations caused by their mental and psychological disabilities, And the special attention of the criminal legislature, in order to place them under the banner of formal and substantive laws, is undeniable, and this is one of the pathological criteria for supporting this group in international documents. The purpose of this article is to pathologically explain the desirable legal protection of mentally retarded victims in the Iranian penal system by looking at international documents and American law.</span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="background:#f2f2f2">Method:</span></b> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<span style="font-family:"Times New Roman","serif"" lang="EN"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN" style="background:#f2f2f2">Ethical Considerations:</span></b> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.</span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b>Results<span style="background:#f2f2f2">:</span></b><b> </b>The Iranian legislature, and specifically the criminal legislature, has not explicitly paid special attention to the mentally handicapped as special victims in need of protection, except in rare and scattered cases of criminalization and aggravation of punishment, However, in substantive and formal law, it has implicitly adopted its protectionist policies towards this vulnerable group.<span style="font-family:"Times New Roman","serif""></span></span></span><br> <span style="line-height:115%"><b>Conclusion:</b><b> </b>Examining US law, it can be seen that the US legislature has been able to extend the rights of disabled victims to some extent by appointing sponsoring institutions and organizations through the protection of umbrellas.<span style="font-family:"Times New Roman","serif""></span></span><br> <span style="line-height:115%"><b><span style="line-height:115%">Please cite this article as:</span></b></span><br> <span style="line-height:107%">Davoodi M, Haji Tabar Firoozjaei H, Kazemi Joybari M.
