fa چالش‌های حقوق بشری دول اروپایی در محدودکردن حق آزادی شهروندان در دوران شیوع اپیدمی کووید-19 پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">زمینه و هدف:</span></span></b><span lang="FA"><span style="line-height:115%"> ماده 5 کنوانسیون اروپایی حقوق بشر دولت‌ها را از هرگونه مداخله خودسرانه در حق آزادی شهروندان منع کرده است. با این حال شیوع بیماری کووید-19 در سراسر جهان، کشورها را ناچار به در پیش‌گرفتن سیاست‌های منجر به سلب حق آزادی شهروندان یا محدودکردن امکان رفت و آمد آزادانه ایشان در جهت مقابله با این ویروس نموده است. پژوهش حاضر ضمن بررسی تدابیر اتخاذشده جهت مواجهه با شیوع بیماری کرونا از سوی دول اروپایی، به شناسایی مکانیسم‌های مورد استفاده توسط این دولت‌ها جهت توجیه مداخله خود در حق آزادی شهروندان می‌پردازد.</span></span><span dir="LTR" lang="FR"><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b> <span lang="FA"><span style="line-height:115%">این تحقیق از نوع نظری بوده، روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد صورت گرفته است.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.<span style="font-family:"B Nazanin""></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">یافته‌ها:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">حق آزادی شهروندان از جمله حقوق اولیه و اساسی انسان‌ها می‌باشد که کلیه دولت‌ها مکلف به رعایت آن هستند. با این وجود گاه تأمین منافع عمومی جامعه اقتضا دارد که محدودیت‌هایی در این حق اعمال گردد. در این حالت دولت‌ها ناچار خواهند بود محدودیت‌های ایجادشده در این حق را به طرق قانونی توجیه نمایند.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">گرچه تدابیر مورد استفاده دول اروپایی در مواجهه با اپیدمی کووید-19 به منزله محدودکردن حق آزادی شهروندان محسوب می‌شود، ولی دولت‌های اروپایی می‌توانند با استناد به جواز سلب آزادی به منظور جلوگیری از شیوع بیماری عفونی موضوع ماده 5 کنوانسیون و یا حق عدول از تعهدات موضوع ماده 15 کنوانسیون، این اقدامات خود را توجیه نمایند.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:11pt"><span style="line-height:115%"><b>Background and Aim:</b> Article 5 of the European Convention on Human Rights prohibits states from interfering arbitrarily in the right of citizens to freedom. However, the worldwide spread of Covid-19 has forced countries to pursue policies that deprive citizens of their liberty or restrict their free movement to combat the virus. The present study examines the measures taken by European governments to address the outbreak of corona virus and identifies the mechanisms used by these governments to justify their intervention in the right to liberty of citizens.</span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b><span style="background:#f2f2f2">Method:</span></b> This research is of theoretical type. The research method is descriptive-analytical and the method of data collection is library and referring to documents<span style="background:#f2f2f2">.</span><span style="font-family:"Times New Roman","serif"" lang="EN"></span></span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b><span lang="EN" style="background:#f2f2f2">Ethical Considerations:</span></b> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<span style="font-family:"Times New Roman","serif""></span></span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b>Results<span style="background:#f2f2f2">:</span></b><b> </b>The right to liberty of citizens is one of the basic human rights that all governments are obliged to respect it. However, sometimes securing the public interest of society requires restrictions on this right.
