fa مسئولیت مدنی پزشک در درمان بیماران مبتلا به کووید-19 در حقوق ایران با تطبیق در نظام حقوقی آمریکا Physician Civil Liability in the Treatment of Patients with Covid19 in Iranian Law Adapted to the American Legal System پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مسئولیت مدنی دست‌اندرکاران پزشکی به خصوص پزشک از دیرباز مورد مناقشه بوده است. دراین میان، در راستای بهبود روند درمان قطعی بیماران، از جمله مبتلایان کروناویروس و کاهش پرونده‌های دعاوی مسئولیت در دادگاه‌ها، تغییر مبنای مسئولیت مدنی پزشک از «نظریه فرض تقصیر» به «نظریه قابلیت انتساب»، بر مبنای «داوری عرف منعطف با مقتضیات زمان و مکان، برای نزدیک‌ترشدن به عدالت اجتماعی» و «قواعد فقهی معتبر» ضروری است. روش: روش تحقیق پژوهش پیش رو، توصیفی ـ تحلیلی و شیوه گردآوری اطلاعات، مطالعات کتابخانه‌ای است. ملاحظات اخلاقی: این مقاله کاملاً به اصول اخلاقی ـ صداقت، رعایت حقوق و رازداری ـ و اصل مالکیت مادی ـ معنوی پایبند بوده است. یافته‌ها: در حقوق آمریکا، بعد از شیوع کووید-19 و اعلام شرایط اضطراری، قوانین اضطراری فدرال و فرامین اجرایی ایالت‌ها از حالت «آماده به اجرا» به «لازم‌الاجرا» تبدیل و بر مبنای «قاعده احسان» و توجه به حسن نیت پزشک، در صورت عدم قصور در حد سوءرفتار بی‌پروا، سوءرفتار عمدی و تقصیر فاحش، مصونیت از مسئولیت برای پزشک ایجاد شد. در حقوق ایران، بعد از شیوع کووید-19، رویکرد قانونگذار همچنان بر «نظریه فرض تقصیر» استوار است. نتیجه‌گیری: رویارویی با وضعیت اضطراری، مستلزم تصویب قوانین اضطراری است. «پیشگیری از سونامی دعاوی مسئولیت مدنی»، «بهبود روند درمان بیمار از طریق افزایش تمرکز و شجاعت پزشک»، «ناشناخته‌بودن و غیر قابل پیش‌بینی‌بودن بیماری» و «نیاز به پیشرفت علم پزشکی»، اقتضای حمایت از پزشک را داشت و ایجاب می‌کرد تا به استثنائات مسئولیت پزشک در شرایط اضطراری، مانند درمان بیماران مبتلا به کرونا توجه شود و در صورت ارتکاب تسامحی که نه شامل تقصیر عمدی و نه تقصیر سنگین شود، از مسئولیت حمایتی برخوردار گردد.</div> <div style="text-align: justify;">Background and Aim: The civil responsibility of medical professionals, especially physicians, has been disputed for a long time. In the meantime, in order to improve the process of definitive treatment of patients, including those infected with the coronavirus, and to reduce liability lawsuits in the courts, changing the basis of the physician's civil liability from the "Theory of presumption of Fault" to the "The Theory of Attributability". Based on "Flexible Custom Arbitration with the requirements of time and place, to get closer to social justice" and "Valid Jurisprudential Rules" is necessary. Method: The research method of this Article is Descriptive-Analytical and the method of collecting information is Library Studies. Ethical Considerations: This Article has completely adhered to the Moral Principles -Honesty, Respect for Rights and Confidentiality- and the Principle of Material-Intellectual Property. Results: In US Law, after the outbreak of Covid-19 and the declaration of emergency, the federal emergency laws and the executive orders of the states changed from "Ready to Enforce" to "Enforceable" and based on "The Ihsan Rule" and paying attention to the goodness of the physician. In the absence of negligence to the extent of reckless misconduct, intentional misconduct and gross negligence, immunity from liability was created for the physician. In Iranian law, after the outbreak of Covid-19, the legislature's approach is still based on the "The Theory of Presumption of Fault". Conclusion: Facing an emergency requires passing emergency laws. "Preventing the Tsunami of Civil Liability Claims", "Improve the Patient's Treatment process by increasing the physician's focus and courage", "Unknown and Unpredictable Disease" and "The Need for advances in medical science" required the support of the physician and he demanded to pay attention to the exceptions of the physician's responsibility in emergency situations, such as the treatment of patients with corona and in case of negligence that does not include intentional fault or gross fault, he should be entitled to support responsibility.
