fa سیاست جنایی اجرایی نظام حقوقی ایران در قبال پیشگیری از جعل در پرتو قانون ثبت اسناد و املاک پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL" lang="AR-SA"><span style="line-height:115%">جعل یکی از مهم‌ترین جرائم ثبتی است. ویژگی خاصی که جرم ثبتی و از جمله جرم جعل را از جرم عمومی متمایز می‌کند، این است که جرم ثبتی در ارتباط مستقیم با ثبت رسمی اسناد و املاک است. در این مقاله تلاش شده به بررسی این سؤال مهم پرداخته شود که</span></span> <span dir="RTL" lang="AR-SA"><span style="line-height:115%">سیاست جنایی اجرایی نظام حقوقی ایران در قبال پیشگیری از جعل در پرتو قانون ثبت اسناد و املاک چگونه قابل تحلیل است؟ مقاله حاضر توصیفی ـ تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی موضوع مورد اشاره پرداخته است. نتایج بیانگر این امر است که سیاست کیفری ایران در پیشگیری از جعل ثبتی، مبتنی بر پیشگیری کیفری و به صورت سرکوبگرانه است. قانونگذار در حیطه پیشگیری غیر کیفری در قالب پیشگیری با وضع قوانین ثبت الکترونیک گام مهمی در راستای پیشگیری از جعل ثبتی برداشته است. بر این اساس، حذف دفاتر دست‌نویس، اجرای ثبت الکترونیک در دفاتر اسناد رسمی و تجهیز دفاتر اسناد رسمی به سامانه اخذ اثر انگشت الکترونیکی تا حدود زیادی سردفتر را در امر احراز هویت یاری می‌کند و زمینه‌ساز کاهش جرائم جعل و در حکم جعل ثبت شده و به ارتقای سرعت و دقت در تنظیم و ثبت اسناد، احراز هویت اشخاص، جلوگیری از سوءنیت استفاده‌کنندگان گردیده است.</span></span> <span dir="RTL" lang="AR-SA"><span style="line-height:115%">علاوه بر این، پیشگیری اجتماعی به صورت فرهنگ سازی می‌تواند در مقاله با جرم جعل ثبتی تأثیرگذار باشد، اما واقعیت امر است که پیشگیری وضعی بیشتر تأثیر را به همراه دارد.</span></span></span></span></div> <div style="text-align: justify;"><span lang="EN" style="font-size:11.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Forgery is one of the most significant registration crimes.</span></span></span> <span lang="EN" style="font-size:11.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">A special feature that distinguishes the crime of registration, including the crime of forgery from the public crime, is that the registration crime is directly related to the official registration of documents and property. This paper aims at examining the important question of how the executive criminal policy of the Iranian legal system in relation to the prevention of forgery can be analyzed in the light of the Law on Registration of Deeds and Property.</span></span></span> <span lang="EN" style="font-size:11.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">The present paper is an analytical descriptive, applying the library method. The results indicate that Iran&#39;s criminal policy in preventing registration forgery is based on criminal prevention and repressive.</span></span></span> <span lang="EN" style="font-size:11.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">The legislator has taken an important step in the field of non-criminal prevention in the form of prevention by enacting electronic registration laws in order to prevent registration forgery. Accordingly, the elimination of handwritten books, the implementation of electronic registration in notaries, and the equipping of notaries with electronic fingerprinting systems will greatly assist the notary in authentication and also has paved the way for reducing the crimes of forgery It also leads to improving the speed and accuracy in preparing and registering documents, authenticating individuals, and preventing the malice of users.
