fa تحلیل زیست‌محیطی نسل سوم حقوق بشر با تأکید بر ضمانت اجرا پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">رویکرد نسل سوم حقوق بشر نسبت به محیط زیست و ضمانت اجرای حمایت از محیط زیست از موضوعات مهمی است که در این مقاله تلاش شده مورد</span> <span lang="AR-SA">بررسی قرار گیرد.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">مقاله مورد اشاره توصیفی ـ تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی موضوع مورد اشاره پرداخته و جمع‌آوری داده‌ها، با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر، اصالت متن، صداقت و امانتداری رعایت شده است.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">برای آسیب به محیط زیست مجازات‌هایی چون جبران خسارت، جریمه مالی و اعاده به وضع سابق در نظر گرفته ‌شده است. ضمانت اجراهای مدنی و اداری در حوزه خسارات‌های زیست‌محیطی قادر به جبران کامل خسارات وارده به محیط زیست و قربانیان انسانی آن نمی‌باشند. به عبارتی جریمه‌های مالی نتوانسته است بازدارنده در مقابل نقض‌های زیست‌محیطی باشد، لذا این ناکارآمدی با به کارگیری حقوق کیفری به عنوان امری مکمل در کنار ضمانت اجراهای موجود مورد توجه قرار گرفته است. در حقوق ایران نیز برای تخریب محیط زیست مجازات‌هایی مانند جزای نقدی و حبس به عنوان ضمانت اجرا تعیین شده است، اما مجازات‌های تعیین‌شده به ویژه میزان جزای نقدی، از بازدارندگی کافی برخوردار نیست.</span><b><span lang="FA"><span style="font-family:"B Nazanin""></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">جامعه بین‌المللی متوجه بهره‌گیری از ضمانت اجرای کیفری در حمایت از محیط زیست در عرصه بین‌المللی شده و هرچند محدودساز و کار کیفری را وارد حوزه حقوق محیط زیست بین‌الملل کرده است، اما این امر با چالش‌هایی مانند</span> <span lang="AR-SA">حقوق بین‌الملل کلاسیک و حاکمیت‌محور، ماهیت خود محیط زیست و همچنین محدودیت‌های حقوق کیفری مواجه است. در حقوق ایران نیز لازم است ضمانت کیفری کارآمدتری به عنوان ضمانت اجرای کیفری تعیین شود.</span><b><span lang="FA"><span style="font-family:"B Nazanin""></span></span></b></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> <span lang="EN">The approach of the third generation of human rights towards the environment and guaranteeing the implementation of environmental protection is one of the important issues to be investigated in the present paper.</span><span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Method:</span></b> <span lang="EN">This paper is descriptive and analytical, using the library method, and it investigated the above-mentioned subject and the data was collected by referring to documents, books and articles.</span></span><br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b><span lang="EN"> In all stages of writing the present research, the originality of the text, honesty and trustworthiness have been observed.</span><span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b> For damage to the environment, punishments such as compensation, financial fine, and restoration to the previous situation have been considered. The guarantees of civil and administrative actions in the field of environmental damages are not able to fully compensate the damages caused to the environment and its human victims. In other words, financial fines have not been able to deter environmental violations. Therefore, this inefficiency has been taken into consideration by applying criminal law as a supplement to the guarantee of existing implementations. In Iran&#39;s laws, punishments such as fines and imprisonment have been determined for environmental destruction as a guarantee of execution, but the determined punishments, especially the amount of fines, do not have sufficient deterrence.<span style="font-family:"Times New Roman","serif""></span></span><br> <b><span style="color:maroon">Conclusion:</span></b><b> </b><span lang="EN">The international community has noticed the use of the guarantee of criminal implementation in the protection of the environment in the international arena, and it has brought the criminal mechanism into the field of international environmental law in a limited way, but it faces the challenges, such as classical and sovereignty-oriented international law, the nature of the environment itself as well as the limitations of criminal law.
