fa بررسی مشروعیت فرآیند شبیه‌سازی سلول‌های بنیادی در پرتو نظرات فقهای امامیه و عامه The Legitimacy of the Process of Human Cloning in the Light of the Opinions of Imamiyyah and Sunni Jurists پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: فرآیند شبیه‌سازی سلول‌های بنیادی یکی از مسائل مهمی می‌باشد که در سال‌های اخیر در حوزه مهندسی ژنتیک مورد توجه ویژه قرار گرفته است. هدف از پژوهش حاضر، بررسی مشروعیت فرآیند مزبور در پرتو نظرات فقهای امامیه و اهل سنت می‌باشد. روش: این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش حاضر نشان می‌دهد، با در نظرگرفتن آثار مختلفی که فرآیند شبیه‌سازی در جامعه ایجاد می‌کند، لازم است که حکم به جواز فرآیند مزبور چه از منظر درمانی و چه از منظر تولید مثلی صادر شود. نتیجه‌گیری: انواع فرآیند همسان‌سازی‌ها اعم از تحقیقی (پژوهشی) درمانی و تکثیری، اساساً خلقت تلقی نمی‌گردد و نوعی صنعت آزمایشگاهی محسوب می‌گردد و برخلاف ادعاهای برخی دین‌گرایان و دیدگاه فقهای اهل سنت و دانشمندان اخلاق‌گرا، هیچ دخالتی مستقیم یا غیر مستقیم در مشیت آمرانه واجب‌الوجود تلقی نمی‌گردد، زیرا خلق و خلقت منحصر است به هستی‌ بخشیدن به عدم که مختص ذات احدیت است.</div> <div style="text-align: justify;">Background and Aim: The human cloning process is one of the important issues that have received special attention in the field of genetic engineering in recent years. The aim of the current research is to investigate the legitimacy of the mentioned process in the light of the opinions of Imamiyyah and Sunni jurists. Method: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Results: The findings of the present research show that, considering the various effects that the Cloning process creates in the society, it is necessary to issue a ruling on the permission of the mentioned process, both from a therapeutic and a reproductive perspective. Conclusion: All kinds of Cloning processes, including therapeutic and reproductive research, are basically not considered creation and are considered a kind of laboratory industry and contrary to the claims of some religious people and the views of Sunni jurists and ethical scientists, no direct or indirect intervention in the imperative providence is considered obligatory, because creation is unique to giving existence to non-existence, which is specific to the essence of unity.
