fa مطالعه لزوم جرم انگاری باقی مانده های دارویی در مواد غذایی پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b><span lang="FA"> برخی از تولیدکنندگان مواد غذایی جهت کسب سود بیشتر در پی افزایش راندمان تولید، اقدام به استفاده بی‌رویه از داروها و محرک‌های رشد مجاز یا غیر مجاز می‌کنند. با توجه به تنوع داروها و محرک‌های رشد مورد استفاده از سوی تولیدکنندگان و گستردگی آثار این جرائم به اندازه افراد جامعه و حتی تأثیر آن بر نسل آتی جامعه و با هدف حمایت از شهروندان، می‌بایستی با شناسایی </span><span dir="LTR">MRL</span> (حداکثر میزان باقیمانده مواد دارویی در پروتئین‌ها) و جرم‌انگاری تخطی از آن در قوانین داخلی، ضمن اجرای عدالت کیفری به یک سیاست جنایی مؤثر در پیشگیری از این‌گونه جرائم دسترسی پیدا کرد.</span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b><span lang="FA"> در این مقاله با روش توصیفی ـ تحلیلی، ضمن تعریف </span><span dir="LTR">MRL</span> و تأثیر آن بر مصرف‌کنندگان مواد غذایی، به بررسی نحوه ارتکاب این جرائم و پتانسیل موجود در قوانین فعلی، به لزوم شناسایی <span dir="LTR">MRL</span> و جرم‌انگاری آن در سیستم قانونگذاری ایران پرداخته می‌شود.<span style="color:black"></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA"><span style="color:black">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span></span><span lang="FA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b><span lang="FA"> در سطح ملی به جهت عدم تعریف دقیق از </span><span dir="LTR">MRL</span> و شناسایی میزان سطح باقیمانده دارویی و محرک‌های رشد در مواد غذایی و همینطور وجود خلأ تقنینی در قبال این جرائم، می‌بایستی مقنن با تعریف <span dir="LTR">MRL</span> و با جرم‌انگاری تخطی از آن، از شهروندان و نسل آینده حمایت نماید.</span></span><br> <b><span dir="RTL" lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b><span dir="RTL" lang="FA"> می‌توان نتیجه گرفت که در سطح قوانین داخلی، با وجود پتانسیل موجود در قانون خوردنی و آشامیدنی و آرایشی و بهداشتی مصوب 22/4/1346، با عدم شناسایی </span>MRL<span dir="RTL"> و سطح استاندارد آن عملاً امکان برخورد با جرائم مربوط به وجود باقیمانده‌های دارویی در مواد غذایی وجود ندارد.</span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> Some of food producers use legal or illegal drugs and growth stimulants in order to gain more profit because of increasing production efficiency. Considering the variety of drugs and growth of stimulants used by the manufacturers and the extent of these crimes&rsquo; effects as much as the society&rsquo;s people and even its impact on the future generation of the society of one hand, and with the aim of protecting the citizens of the other hand, it is necessary to gain an effective criminal policy in preventing such crimes via identify the MRL (maximum amount of remaining pharmaceutical substances in proteins) and criminalization of its violation in domestic laws, while implementing criminal justice.</span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Methods:</span></b> In this article, while defining MRL and its effect on food consumers as well as examining the way these crimes are committed and their potential in current laws, the need to identify MRL and criminalize it in Iran law system is investigated with a descriptive and analytical method.<span style="font-family:"Times New Roman","serif"" lang="EN"></span></span><br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed.</span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b><b> </b>At the national level, due to lack of a precise definition of MRL and identification of the drug residue and growth stimulants level in food as well as presence of a legal gap in relation to these crimes, the legislator should protect the citizens and the future generation by defining the MRL and criminalizing its violation.</span><br> <b><span style="color:maroon">Conclusion:</span> </b>It can be concluded that at the level of domestic laws, despite the potential in the food and drink law, it is practically not possible to deal with the crimes related to presence of pharmaceutical residues in food due to lack of MRL recognition and its standard level.<br> <br> <b>Please cite this article as:</b><br> Abbasnezhad J, Ahadi F, Abbasi M, Beigi J.
