fa حمایت از استارت‌آپ‌ها در پرتو حقوق مالکیت معنوی در ایران و اسناد بین‌المللی پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b><span lang="FA"> کسب و کارهای نوپا (استارت‌آپ‌ها) دارای ابعاد حقوقی مختلفی است. حقوق مالکیت معنوی کسب و کارهای نوپا (استارت‌آپ‌ها) از موضوعات مهمی است که در این مقاله مورد بحث و بررسی قرار گرفته است.</span><span lang="AR-SA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="FA">مقاله حاضر توصیفی ـ تحلیلی بوده و از روش کتابخانه‌ای به بررسی موضوع مورد بحث پرداخته ‌شده است.</span><span lang="AR-SA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b><span lang="FA"> یافته‌ها بر این امر دلالت دارد که یکی از روش‌های حمایت از کسب و کارهای نوپا (استارت‌آپ‌ها)، حمایت از حقوق مالکیت معنوی این نوع کسب و کارهاست. حمایت از حق اختراع/ پتنت،</span> <span lang="FA">حمایت از اسرار تجاری، حمایت از نشان تجاری و حق تکثیر مهم‌ترین سازوکارهای حمایت از حقوق مالکیت معنوی کسب و کارهای نوپا (استارت‌آپ‌ها) در حقوق ایران و اسناد بین‌المللی است، البته چالش‌های در این خصوص مطرح است: عدم شمولت قانون حمایت از شرکت‌های دانش‌بنیان از همه کسب و کارهای نوپا به عنوان مهم‌ترین قانون حمایتی در این زمینه، عدم سازوکارهای حمایتی از تجاری‌سازی اختراعات و ایده‌ها در کسب و کارهای نوپا بعد از ثبت و عدم اطمینان و ناامنی فعالیت این حوزه در خصوص ایده‌های نوآورانه‌شان از مهم‌ترین چالش‌های در این خصوص است.</span></span></span><br> <b><span dir="RTL" lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b><span dir="RTL" lang="FA"> لازم است از ابتدای شکل‌گیری استارت‌آپ، بحث مالکیت معنوی مورد توجه قرار گرفته و همچنین حمایت‌های لازم در راستای تجاری‌سازی ایده‌ها و اختراعات کسب و کارهای نوپا صورت گیرد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="line-height:2;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> Startups have various legal aspects. The intellectual property rights of startups are one of the important issues discussed in this paper.<span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Method:</span></b> The present paper is descriptive-analytical and the issue under discussion is investigated using the library method.<span lang="EN"><span style="font-family:"Times New Roman","serif""></span></span></span><br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed.<span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b> The findings indicate that one of the ways to support startups is to protect the intellectual property rights of these types of businesses. Patent protection, trade secret protection, trademark protection and copyright are the most important mechanisms for protecting the intellectual property rights of startups in Iranian law and international documents.
