fa اعاده دادرسی کیفری بر پایه آزمایش دی‌ان‌ای (تعامل حقوق کیفری و پزشکی برای تحقق واقعیت) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="FA">آزمایش دی‌ان‌ای یکی از ابزارهایی می‌باشد که در سال‌های اخیر در حوزه حقوق کیفری و جرم‌شناسی مورد توجه قرار گفته است. هدف از پژوهش حاضر، تحلیل اعاده دادرسی کیفری بر پایه آزمایش دی‌ان‌ای می‌باشد.</span><span dir="LTR"><span style="line-height:115%"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">روش:</span></span></b> <span lang="FA">این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><b><span lang="AR-SA"><span style="color:maroon"></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="FA">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><span lang="AR-SA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">یافته‌ها:</span></span></b> <a name="_Hlk151203311"><span lang="AR-SA">علم حاصل از آزمایش دی‌ان‌ای با واسطه (کارشناس) و نه به صورت مستقیم برای قاضی حاصل می‌شود؛ چالش اساسی در ارتباط با عدم امکان پذیرش آزمایش‌های مزبور در قامت یکی از دلایل قطعی اثبات جرم همین موضوع می‌باشد.</span></a><span lang="AR-SA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">نتایج پژوهش نشان می‌دهد که آزمایش دی‌ان‌ای می‌تواند مبنای قاطع برای اعاده دادرسی جهت‌مدار و نیز اعاده دادرسی مقام‌مدار (از سوی محکوم‌علیه) محسوب شود، اما آزمایش مزبور برای اعاده دادرسی مقام‌مدار (از سوی شاکی) مبنای ظنی یا غیر قاطع محسوب می‌شود.</span><b><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></b></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><b><span style="color:maroon">Background and Aim:</span></b> DNA testing is one of the tools that have received attention in the field of criminal law and criminology in recent years. The purpose of the present research is to analyze the restoration of criminal proceedings based on DNA testing.<span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span><br> <b><span style="color:maroon">Method:</span></b> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<b><span lang="EN"><span style="color:maroon"></span></span></b><br> <b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <b><span style="color:maroon">Results:</span></b> The knowledge obtained from the DNA test, is obtained through an intermediary (expert) and not directly for the judge; the basic challenge related to the impossibility of accepting the said tests as one of the definitive reasons for proving the crime is the same issue.<span style="color:black"></span><br> <b><span style="color:maroon">Conclusion:</span></b><b> </b>The results of the research show that the DNA test can be considered as a decisive basis for resuming the judicial proceedings as well as the resumption of the official proceedings (by the convict), but the said test for the resumption of the official proceedings (from the side of the plaintiff) is considered a presumptive or inconclusive basis.<br> <br> <b>Please cite this article as:</b><br> Kakwan SH, Goldoust Jouybari R, Niazpour AH, Azimzadeh SH.
